ORDER NO. 90-9

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 18, 1975 at 9 a.m., in Room 532, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion to consider the rescinding of orders in Cause No. 90 for the Orchard Field.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on May 15, 1956 the Commission issued its Order No. 90-1 for the Orchard Field which established 40-acre drilling and spacing units for the production of oil and gas from the "D" and "J" Sands.  Subsequent Order Nos. 90-2, 90-3, 90-4, 90-5 and 90-6 were concerned with allowing wells to be drilled as exceptions and deletion and additions to the spaced area which presently consists of the following:

 

 Township 4 North Range 60 West, 6th P.M.

Section 2:  W½W½,  E½SW¼

Section 9:   All

Section 3:  All

Section 10:  All

Section 4:  All

Section 11:  NW¼

 

4.      That on September 21, 1965 the Commission issued its Order Nos. 90-7 and 90-8 which approved Unit Agreements and Unit Operating Agreements for an East Unit Area and West Unit Area comprising certain lands within the Orchard Field described in Finding 3 herein.

 

5.      Since all wells in the area, described in Finding 3 herein, are now plugged and abandoned, the Unit Agreements are terminated and in order to promote future development, all orders in Cause No. 90 are no longer necessary and should be vacated and the area governed by the general rules and regulations of the Commission.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the previous orders in Cause No, 90 for the Orchard Field, Morgan County, Colorado, are hereby rescinded, and operations in the area as described in Finding 3 herein shall be governed by the general rules and regulations of the Commission.
