REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on January 28, 1958, at 10:00 a.m., in the Game Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the Gulf Oil Corporation and Williamson, Kissinger and Company, for an order vacating Order No. 90-1 issued May 15, 1956, in Cause No. 90, Orchard Field, insofar as it pertains to the "D" and "J" Sands in the E/2 and E/2 W/2 of Section 2, all of Section 11 except the W/2 NW/4, and all of Section 1, Township 4 North, Range 60 West of the 6th P.M., Morgan County, Colorado.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That on May 15, 1956, the Commission issued its Order No. 90-1 in Cause No. 90, Orchard Field, establishing forty-acre drilling and spacing units for the production of oil and gas from the "D" and "J" Sands, common source of supply, and defining the area to be known as the Orchard Field.

4.      That subsequent development reveals that the E/2 and E/2 W/2 Section 2 and all of Section 11 except W/2 NW/4 and all of Section 1, Township 4 North, Range 60 West, 6th P.M., Morgan County, Colorado, should be deleted from the Orchard Field.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the East Half (E/2) and East Half (E/2) West Half (W/2) Section Two (2) all of Section Eleven (11) except West Half (W/2) Northwest Quarter (NW/4) and all of Section One (1), Township Four (4) North, Range Sixty (60) West, 6th P.M., Morgan County, Colorado, is hereby deleted from the area described in Order No. 90-1, Cause No. 90, Orchard Field, leaving the area of Orchard Field as follows:

West Half (W/2) West Half (W/2), Section Two (2).  All of Sections Three (3), Four (4), Nine (9), Ten (10), West Half (W/2) Northwest Quarter (NW/4) Section Eleven (11), Township Four (4) North, Range Sixty (60) West, 6th P.M., Morgan County, Colorado.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
