CAUSE NO. 84

ORDER NO. 84-4           (Corrected)

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on April 16, 1984 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Russel A. Pomeroy, Beatrice Pomeroy and Buckhorn Petroleum Co., for an order approving a waterflood project for secondary recovery purposes from the Muddy formation reservoir underlying the Ft. Collins Muddy Formation Unit Area.

FINDINGS

The Commission finds as follows:

1.      Russel A. Pomeroy, Beatrice Pomeroy and Buckhorn Petroleum Co., as applicants herein, are interested parties in the subject matter of the above-referenced hearing.

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4.      On February 17, 1978, the Commission issued Order No. 84-2 which approved a Unit Agreement for the Ft. Collins Muddy Formation Unit Area consisting of the following described lands in Larimer County, Colorado, to-wit:

Township 8 North, Range 68 West, 6th P.M.

Section 7: SE1/4

Section 8:  SW1/4NW1/4, W1/2 SW1/4 lying south of southwest

boundary of reservoir No. 6

Section 17:  W1/2W1/2

Section 18:  E1/2, SE1/4SW1/4

Section 19:  Lot 1, Lot 2, E1/2, E1/2W1/2

Section 20:  W1/2NW1/4

Section 30:  Lot 1, Lot 2, E1/2, E1/2W1/2

Section 31: Lot 1, E1/2 NW1/4, NE1/4 less 33 acres south

of southwest boundary of

Long Pond

containing 2,361.31 acres more or less.

The Commission, on October 16, 1978, by Order No. 84-3, approved a pilot secondary recovery program by the injection of water into Well No. 2 Krause, NE1/4NW1/4 Section 19, Township 8 North, Range 68 West and Well No. 5 Community, SE1/4SE1/4, Section 18, Township 8 North, Range 68 West, 6th P.M.

5.      Evidence presented at the hearing indicates that a secondary recovery program by the injection of water into the Muddy formation reservoir underlying the Ft. Collins Muddy Formation Unit Area as described herein, is necessary to increase the ultimate recovery of oil and that said project will not adversely affect the correlative rights of any interest owner in the area.

6.      Approval should be given to the project which will commence with an additional pilot waterflood in the S1/2 Section 19, Township 8 North, Range 68 West, 6th P.M., and then expand in subsequent phases throughout the unit area by the drilling of additional injection wells, convert existing wells to injection wells, and additional producing wells, as it becomes necessary, without further notice and hearing, subject to the approval of the Director.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the secondary recovery project by the injection of water into the Muddy formation reservoir underlying the Ft. Collins Muddy Formation Unit Area described herein, is hereby approved.

IT IS FURTHER ORDERED, that the operator is hereby authorized to commence the project with an initial pilot flood in the S1/2 Section 19, Township 8 North, Range 68 West, 6th P.M. and expand the project in subsequent phases throughout the unit area by the drilling of additional injection wells, converting existing wells to injection wells, and producing wells as it becomes necessary, without further notice and hearing, subject to the approval of the Director.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

ENTERED this 10th day of May 1984, as of April 16, 1984.
