CAUSE NO. 58

ORDER NO. 58-3

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 18, 1968, at 10:00 a.m., in Room 260, Columbine Building, Denver, Colorado, after publication of Notice of Hearing, as required by law, on the Commission's own motion to consider the vacating of Order No. 58-1 in the Rago-North Field.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That as a result of recent development of the "J" sand reservoir in the Rago-North Field, both within the field limits and outside the spaced area, Order No. 58-1 is no longer necessary and should be vacated, and provisions of this Commission's general rules and regulations should prevail.

4.      That all wells previously drilled in accord with provisions of said order and in conflict with Rule 316 of the Rules and Regulations of this Commission should be authorized as exceptions and allowed to be recompleted in any formation underlying said Rago-North Field, regardless of the location of such wells.

ORDER

NOW, THEREFORE, IT IS ORDERED that Order No. 58-1 is hereby vacated, and operations in the area known as the Rago-North Field shall hereafter be governed by the general rules and regulations of this Commission.

IT IS FURTHER. ORDERED, that the location of all wells drilled previous to this order, in the area defined in Order No. 58-1, shall be allowed and not held in conflict with Rule 316 of the Rules and Regulations of this Commission; and any well drilled previous to this order may be recompleted in any formation in said area, regard-less of the location of such well.

ORDERED this 18th day of June 1968.
