REPORT OF THE COMMISSION

TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:

This cause came on for hearing before the Commission on January 16, 1987 at 9:00 A.M. in Room 110, State Centennial Building 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing, as required by law, on the Commission's own motion requesting Noram Mines Inc. to appear to the charge of non-compliance of Order No. 447-1.

FINDINGS

The Commission finds as follows:

1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. The Commission has jurisdiction over the subject matter embraced in the notice of the aforesaid hearing, and of the parties interested therein, as well as jurisdiction to promulgate the hereinafter prescribed order.

3. Order No. 447-1 ordered Noram Mines Inc. to furnish within thirty (30) days a plugging bond in accordance with Rule 304 for well No. 1 Graefe located in the NW/4 NE/4 Section 26, Township 9 North, Range 62 West 6th P.M.

4. By letter, dated December 22, 1986, Noram Mines Inc. stated that it was not determined by the Court action that it became the operator of said well and should not have been required to post a bond as required by Order No. 447-1. However, Noram is willing to plug the well and has proceeded in doing so at this time.

5. Noram Mines Inc. should proceed with the plugging of said well No. 1. Graefe and Order No. 447-1 should, therefore, be rescinded upon completion of the plugging.

ORDER

NOW THEREFORE IT IS ORDERED that Noram Mines Inc. shall proceed with the plugging of the well No. 1 Graefe, located in the NW /4 NE /4 Section 26, Township 9 North, Range 62 West 6th P.M., Weld County Colorado.

IT IS FURTHER ORDERED that Order No. 447-1 requiring Noram Mines Inc. to post a bond on said well No. 1 Graefe is hereby rescinded.
