REPORT OF THE COMMISSION

TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:

This cause came on for hearing before the Commission on September 17, 1984 and continued to October 15, 1984 in Suite 380 Logan Tower Building, 1580 Logan Street, Denver, Colorado 80203, after giving Notice of Hearing as required by law, at which time testimony was taken concerning the complaint of Skaer Enterprises, Inc. alleging watering out of certain wells, in particular Well No. 2 Schwartz, located in the E/2E/2NE/4 Section 28, Township 3 South, Range 50 West, 6th P.M. in the Pod Field producing from the "J" Sand, by the injection of produced water into Well No. B-4 Christiansen, located in the SW/4NW/4 Section 27, Township 3 South, Range 50 West, 6th P.M. operated by Gulf Oil Exploration & Production Co. The Commission determined that additional information and testing was necessary to make the proper determination in this matter. The results of such tests were submitted for review to the Director who made a recommendation to the Commission at the hearing of January 21, 1985 in Room 110 State Centennial Building, 1313 Sherman Street, Denver, Colorado.

FINDINGS

The Commission finds as follows:

1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. Based on results of tests taken, which were ordered by the Commission and agreed to by the interested parties, and evidence presented at the hearings indicates that there is no communication between the water disposal Well No. B-4 Christiansen, located in the SW/4NW/4 Section 27, Township 3 South, Range 50 West, 6th P.M. and operated by Gulf Oil Exploration and Production Co., and Well No. 2 Schwartz, located in the E/2E/2NE/4 Section 28, Township 3 South, Range 50 West, 6th P.M.; therefore Gulf should be allowed to continue use of said Well No. B-4 Christiansen as a water disposal well.

ORDER

NOW, THEREFORE, IT IS ORDERED, that Gulf Oil Exploration and Production Co. is hereby authorized to continue use of WeLl No. B-4 Christiansen, located in the SW/4NW/4 Section 27, Township 3 South, Range 50 West, 6th P.M., Pod Field, Washington County, Colorado, as a water disposal well.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
