ORDER NO. 40-3

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on December 1, 1954, at 10:00 A.M., in Room 704, State Capital Annex, 14th Avenue and Sherman Street, Denver, Colorado, after publication of Notice of Hearing, as required by law, on the application of the British-American Oil Producing Company for an order from the Commission to amend Order No. 40-1 by extending the boundaries of the Mt. Hope-East Field in Logan County, Colorado, to include Lots 2, 3, and 4 of Section 4, and Lots 1 and 2 of Section 5, Township 8 North, Range 53 West of the 6th P.M., Logan County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place, and purpose of the hearing has been given in all respects, as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the "D" sand of the Mt. Hope-East Field constitutes a common source of supply of oil and gas underlying, in addition to the area set forth in Cause No. 40, Order No. 40-1, the following described lands in Logan County, Colorado:

 

Township 8 North, Range 53 West, 6th P.M.

 

 

Section 4:

Lots 2, 3, 4

Section 5:

Lots 1 and 2

 

ORDER

 

IT IS THEREFORE ORDERED, that the following rules and regulations shall apply hereafter to the lands set forth in this Order, and to those lands set forth in Cause No. 40, Order No. 40-1, referred to as the Mt. Hope-East Field, in Logan County, Colorado, in addition to other applicable rules, regulations, and orders of the Commission heretofore adopted and not in conflict herewith.

 

Rule 1.    That all the rules, regulations, and orders of this Commission, as set forth in Cause No. 40, shall be and the same are hereby established for the production of oil and gas from the "D" sand, common source of supply underlying the following described lands, which include the additional area herein described in the Findings, which by reference are made a part hereof:

Lots Two (2), Three (3), and Four (4), Section Four (4); and Lots One (1) and Two (2), Section Five (5), Township Eight (8) North, Range Fifty-three (53) West of the 6th P.M.; and

 

West Half (W/2), West Half of Southeast Quarter (W/2 SE/4), and Southeast Quarter of Southeast Quarter (SE/4 SE/4) of Section Twenty (20); South Half of South Half (S/2 S/2) of Section Twenty-one (21); All of Sections Twenty-eight (28), Twenty-nine (29), and Thirty-two (32); North Half of North Half (N/2 N/2), Southwest Quarter of Northwest Quarter (SW/4 NW/4), and West Half of Southwest Quarter (W/2 SW/4) of Section Thirty-three (33), all in Township Nine (9) North, Range Fifty-three (53) West of the Sixth (6th) P.M.,

 

All in Logan County, Colorado,

 

and such area shall henceforth be known as the Mt. Hope-East Field.

 

IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of any well or wells in the "D" sand formation for the purpose of producing oil and gas therefrom, at a location other than authorized by previous orders, Cause No. 40, and by this Order, is hereby prohibited.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above rules and regulations.
