ORDER NO. 39-2

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 18, 1971, at 9 a.m. in Room 132, State Services Building, 1525 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion to consider the vacating of Order No. 39-1, in the Westplains [sic] Field.

 

                                                                     FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place, and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on July 22, 1954, the Commission issued its Order No. 39-1, which established 40-acre drilling and spacing units for the production of oil and gas from the "D" Sand underlying the Westplains [sic] Field.

 

4.      Since there is only one remaining marginal producing well in the "D" Sand, and in order to promote future development Order No. 39-1 in Cause No. 39 is no longer necessary and should be vacated, and provisions of the Commission's general rules and regulations should prevail.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order No. 39-1 in Cause No. 39 is hereby vacated, and operations in the area known as the Westplains [sic] Field shall hereafter be governed by the general rules and regulations of this Commission.
