REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on October 18, 1982 at 9:00 am in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Viable Resources, Inc. requesting the Commission to vacate Order No. 387-1, or in the alternative to amend said order and establish 80-acre drilling and spacing units for the production of gas and associated hydrocarbons from the "J" Sand underlying certain lands in the Barbwire Field. In addition, it was ordered by Order No. 387-1 that a further hearing would be held on October 18, 1982 to determine if additional lands should be included in the spaced area as established by Order No. 387-1.

FINDINGS

The Commission finds as follows:

1. Viable Resources, Inc., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4. After hearing held July 19, 1982 and continued to August 16, 1982, the Commission issued Order No. 387-1 which established 160-acre drilling and spacing units for the production of gas and associated hydrocarbons from the "J" Sand underlying Section 20, Township 1 North, Range 63 West, 6th rrrtt, Barbwire Field, Weld County, Colorado.

5. Evidence presented at the hearing indicates that proper Notice of Hearing was not given to all interested parties concerning this matter; therefore, Order No. 387-1 should be vacated.

ORDER

NOW, THEREFORE, IT IS ORDERED, that Order No. 387-1, issued as of August 16, 1982 and entered as of September 13, 1982 is hereby vacated.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
