REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on November 19, 1984 at 9:00 A.M., in Suite 380, Logan Tower Building, 1580 Logan Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Bellwether Exploration Co. for an order granting an exception to the permitted well location as provided for in Order No. 381-1.

FINDINGS

The Commission finds as follows:

1. Bellwether Exploration Co., as applicant-herein, is an interested party in the subject matter of the above-referenced hearing.

2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4. A well was permitted in accordance with the provisions of Order No. 381-1; however, due to a surveying error the well was actually drilled at a location 2633 feet from the south line and 725 feet from the east line Section 25, Township 6 North, Range 66 West.

5. Based on a verified application presented at the hearing and having received waivers of objection from interested parties, the Commission should grant an exception to the permitted well location as provided for in Order No. 381-1 for the well drilled at the location as described in Finding 4 herein.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception to the permitted well location as provided for in Order No. 381-1 is hereby granted for a well drilled at a location 2633 feet from the south line and 725 feet from the east line Section 35, Township 6 North, Range 66 West.
