REPORT OF THE COMMISSION

TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:

This cause came on for hearing before the Commission on January 16, 1987, at 9:00 A.M. in Room 110, State Centennial Building, 1313 Sherman Street, Denver, Colorado, on the Commission's own motion to review the provisions of Order No. 343-4 for the Eckley Field, Yuma County, Colorado.

FINDINGS

The Commission finds as follows:

1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. On October 17, 1983, the Commission authorized Order No. 353-4 to be issued which amended Order No. 353-1 and allowed an additional well to be drilled for production of gas and associated hydrocarbons from the Niobrara formation underlying each 160-acre drilling and spacing unit in the spaced area of the Eckley Field as established by Order No. 353-1.

4. The Commission reviewed the testimony previously submitted at the October 17, 1983 hearing which was incorporated into this hearing.

5. Mesa Petroleum Company and J. W. Operating Company appeared by counsel. Williams Natural Gas Company filed a Statement of Position electing not to participate.

6. Additional engineering testimony presented at the hearing confirms the faulting in the reservoir and further indicates that allowing the drilling of the additional well in each drilling unit of 160-acres, more or less, has been and is necessary for efficient and economic drainage of the gas from the Niobrara formation.

7. The provisions of Order No. 353-4 are proper, and the Commission hereby affirms its findings therein and the Commission further finds that said Order should remain in effect'

ORDER

NOW THEREFORE IT IS ORDERED that the Oil and Gas Conservation Commission of the state of Colorado affirms Order No. 353-4 as of January 16, 1987, nunc pro tunc October 17, 1983

IT IS FURTHER ORDERED that the Commission expressly reserves its right after notice and hearing to alter, amend or repeal the above order. 6th February ENTERED this day of 1987, as of January 16, 1987.
