ORDER NO. 34-14

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on April 19, 1982, at 9:00 a.m. in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Executive Properties, Inc., for an order granting an exception to the permitted well location as provided for in Order No. 34-1 for the Greenwood Field, Baca County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Executive Properties, Inc., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On July 14, 1954, the Commission issued Order No. 34-1, which among other things, established 640-acre drilling and spacing units for the production of gas from the Topeka-Lansing formation underlying lands in the Greenwood Field, with the permitted well located within 500 feet of the center of the unit.  By subsequent orders, certain lands were added and deleted from the spaced area.

 

5.      A well has been drilled at the permitted location in the NE¼SW¼ [sic] Section 12, Township 32 South, Range 42 West, 6th P.M., Greenwood Field, Baca County, Colorado.  Said well is producing a small amount of gas from the Topeka-Lansing formation.

 

6.      Evidence presented at the hearing indicates that in order to protect correlative rights and allow the production of gas from the Topeka-Lansing formation underlying the unit, an exception should be granted for a well to be drilled at a location 660 feet from the east line and 1980 feet from the south line, Section 12, Township 32 South, Range 42 West, 6th P.M., and that it be the permitted well for the unit.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well to be drilled at a location 660 feet from the east line and 1980 feet from the south line Section 12, Township 32 South, Range 42 West, 6th P.M., Greenwood Field, Baca County, Colorado, and that it be the permitted well for the unit upon which it is located for the production of gas from the Topeka-Lansing formation.

 

IT IS FURTHER ORDERED, that this order shall become effective forthwith.
