ORDER NO. 34-12

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on August 21, 1979 at 9:00 a.m., in Room 318-A, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law on the application of Edwin L. Cox, for an order granting an exception to the spacing pattern established by Order No. 34-1 for the Greenwood Field, Baca County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Edwin 1. Cox, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On July 14, 1954, the Commission issued Order No. 34-1 which among other things, established 640-acre drilling and spacing units for the production of gas from the Topeka-Lansing formation underlying lands in the Greenwood Field, with the permitted well located within 500 feet of the center of the unit.  By subsequent orders, certain lands were added and deleted from the spaced area.

 

5.      Evidence presented at the hearing indicates that a well, the No. Brandt O'Neil was drilled at a location 1470 feet from the west line and 1470 feet from the south line Section 16, Township 34 South, Range 41 West, 6th P.M. to test the Morrow and Keyes formations.  Since these zones were non-productive, the well was plugged back and is capable of production of gas from the Topeka-Lansing formation; therefore, said well should be considered an exception and be the permitted well for the unit upon which it is located.

 

6.      No objection to the application was presented.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted For a well, the No. 1 Brandt-O'Neil, which has been drilled at a location 1470 feet from the west line and 1470 feet from the south line [sic] Section 16, Township 34 South, Range 41 West, 6th P.M., Greenwood Field, Baca County, Colorado, to be the permitted well for the unit upon which it is located for production of gas from the Topeka-Lansing Formation.
