CAUSE NO. 33

ORDER NO. 33-2        (Emergency)

REPORT OF THE COMMISSION

The Oil and Gas Conservation Commission of the State of Colorado has been closely observing the production of oil and gas from the "D" and "J" sands of the Adena South Field in Morgan and Adams Counties, Colorado. This field con-rains oil and gas now in production, and the Commission has heretofore, upon application, notice, and hearing, established drilling and spacing rules in said "D" and "J" sands of the said Adena South Field.

FINDINGS

The Commission finds as follows:

1.      That the Commission has jurisdiction to promulgate the hereinafter prescribed Order.

2.      That, in accordance with the provisions of Sections Four (4) and Five (5) of the Oil and Gas Conservation Act of 1951, as amended, there is being committed in the Adena South Field underground waste, inefficient, excessive or improper use or dissipation of reservoir energy, and the escape, blowing, or releasing, directly or indirectly, into the open air, of gas from wells producing oil or both oil and gas; and that there is being committed in the Adena South Field, the production of gas in quantities or in such manner as is unreasonably reducing reservoir pressures or unreasonably diminishing the quantity of oil or gas that might ultimately be produced.

3.      That an emergency exists which requires immediate action and requires the immediate promulgation of upper limits upon the production of oil and gas for all wells producing oil or both oil and gas in the Adena South Field, in order to prevent and avoid waste, as that term is defined in the Oil and Gas Conservation Act of 1951, as amended, and in order to conserve oil and gas and to secure the greatest ultimate recovery or oil and gas from the Adena South Field; and that an Emergency Order should be issued, in accordance with the provisions of Section 8 (c) of the Oil and Gas Conservation Act of 1951, as amended.

4.      That the operators and owners of all wells producing oil or both oil and gas from the "D" and "J" sands of the Adena South Field should not produce oil from any one well in an amount, during any one month, exceeding a daily average of One Hundred Twenty-five (125) barrels; and should not produce gas from any one well in an amount, during any one month, exceeding a daily average of One Hundred Fifty Thousand (150,000) cubic Feet.

5.      That the Adena South Field, as used herein, is that area in Sections Twenty-five (25), Twenty-six (26), Twenty-seven (27), Twenty-eight (28), Thirty-three (33), Thirty-four (34), Thirty-five (35), and Thirty-six (36), Township One (1) North, Range Fifty-eight (58) West of the Sixth (6th) P.M.; and the South Half (S½) of Section Thirty (30), and all of Section Thirty-one (31), Township One (1) North, Range Fifty-seven (57) West of the Sixth (6th) P.M., all in Morgan County, Colorado; and all of Sections One (1), Two (2), Three (3), and Four (4), Township One (1) South, Range Fifty-eight (58) West of the Sixth (6th) P.M.; and all of Section Six (6), Township One (1) South, Range Fifty-seven (57) West of the Sixth (6th) P.M., all in Adams County, Colorado.

ORDER

IT IS THEREFORE ORDERED, that the operators and owners of all wells producing oil or both oil and gas from the "D" and "J" sands of the Adena South Field, as hereinabove defined in the Findings, which, by reference, are made a part hereof, shall not produce oil from any one well in an amount, during any one month, exceeding a daily average of One Hundred Twenty-five (125) barrels; and shall not produce gas from any one well in an amount, during any one month, exceeding a daily average of One Hundred Fifty Thousand (150,000) cubic feet.

IT IS FURTHER ORDERED, that this Order shall be effective fifteen (15) days, commencing July 1, 1954.
