REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on September 19, 1977, at 9 Kkktt, in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Lee Drilling Company, for an order granting an exception to the spacing pattern established for the Broken Bow Field and allow the re-entry and re-development of an abandoned well located in the SE/4SE/4 Section 32, Township 12 South, Range 44 West, 6th rrrtt

FINDINGS

The Commission finds as follows:

1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. That on February 18, 1977 the Commission issued its Order No. 320-1 which established 80-acre drilling and spacing units for the production of oil from the Mississippian, underlying the Broken Bow Field. The units consist of the N/2 and S/2 or the E/2 and W/2 of each quarter section with the permitted well located in the center of the NE/4 and SW/4 of each quarter section with a tolerance of 150 feet.

4. That a plugged and abandoned well, the No. 1 Pfeifer, is located in the SE/4SE/4- Section 32, Township 12 South, Range 44 West, 6th rrrtt

5. That evidence presented at the hearing indicates that the re-entry and re-development of the plugged and abandoned well, the No. 1 Pfeifer, located in the SE/4SE/4 Section 32, Township 12 South, Range 44 West, 6th rrrtt, would be more geo-logically and economically feasible than a well drilled at the permitted location; there-fore, an exception to the spacing pattern should be allowed, and said Well No. 1 Pfeifer be re-entered and developed for the production of oil from the Mississippian and be the permitted well for the unit consisting of the E/2SE/4 of said Section 32.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception to the spacing pattern as established by Order No. 320-1 is hereby granted for Well No. 1 Pfeifer, located in the SE/4SE/4 Section 32, Township 12 South, Range 44 West, 6th rrrtt, to be re-entered and developed for production of oil from the Mississippian and that it be the permitted well for the unit consisting of the E/2SE/4 of said Section 32.
