REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on August 18. 1980 at 9:00 A.M., in Room 110. State Centennial Building. Denver. Colorado after giving Notice of Hearing as required by law on the application of Samuel Gary Oil Producer for an order granting an exception to the spacing pattern as established by Order No. 310-1 for the Radar Field.

FINDINGS

The Commission finds as follows:

1. Samuel Gary Oil Producer as applicant herein is an interested parry in the subject matter of the above-referenced hearing.

2. Due notice of the time place and purpose of the hearing has been given in all respects as required by law.

3. The Commission has jurisdiction over the subject matter embraced in said Notice and of the parties interested therein and jurisdiction to promulgate the here-inafter prescribed order.

4. That on August 17. 1976, the Commission issued Order No. 310-1 which established 80-acre drilling and spacing units for the production or oil from the "J" Sand underlying certain lands in the Radar Field. Adams County. Colorado. The permitted well for each unit is at a location in the center of the NW/4 and SE/4 of each quarter section with a tolerance of 200 feet for topography or to avoid surface hazards.

5. Geological testimony presented indicates that the SW/4SW/4 Section 36. Township 2 South. Range 64 West. 6th P.M. is the most logical location in Section 36 for potential "D" Sand production. However a well drilled to test the "D" Sand as a primary objective should also be allowed to test the "J" Sand as a secondary objective. which zone was spaced by Order No. 310-1; however if a commercial well is completed at said location and capable of production from the "J" Sand the Commission upon application of any interested person should take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the well drilled into the "J" Sand as an exception.

ORDER

NOW. THEREFORE. IT IS ORDERED. that an exception is hereby granted for a well to be drilled at a location 660 feet from the south line and 660 feet from the west line. Section 36. Township 2 South. Range 64 West. 6th P.M.. Radar Field. Adams County, Colorado and that said well be allowed to drill into and test the "J" Sand. How-ever if the "J" Sand is completed for commercial production the Commission shall. upon application of any interested person take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the well drilled into the "J" Sand as an exception.
