CAUSE NO. 31

ORDER NO. 31-2        (Emergency)

REPORT OF THE COMMISSION

The Oil and Gas Conservation Commission of the State of Colorado has been closely observing the production of oil and gas from the "D" sand of the Masters Field, in Weld and Morgan counties, Colorado. This field contains oil and gas now in production, and the Commission has heretofore, upon application, notice and hearing, established drilling and spacing rules in said "D" sand of the said Masters Field.

FINDINGS

The Commission finds as follows:

1.      That the Commission has jurisdiction to promulgate the hereinafter prescribed Order.

2.      That, in accordance with the provisions of Sections Four (4) and Five (5) of the Oil and Gas Conservation Act of 1951, as amended, there is being committed in the Masters Field underground waste, inefficient, excessive or improper use or dissipation of reservoir energy, and the escape, blowing or releasing, directly or indirectly into the open air, of gas from wells producing oil or both oil and gas; and that there is being committed in the said Masters Field, the production of gas in quantities or in such manner as is unreasonably reducing reservoir pressures or unreasonably diminishing the quantity of oil or gas that might ultimately be produced.

3.      That an emergency exists which requires immediate action and requires the immediate promulgation of upper limits upon the production of oil and gas for all wells producing oil or both oil and gas in the Masters Field, and that in order to prevent and avoid waste, as that term is defined in the Oil and Gas Conservation Act of 1951, as amended, and an order to conserve oil and gas and to secure the greatest ultimate recovery of oil and gas from the Masters Field, an Emergency Order should be issued, in accordance with the provisions of Section 8(c) of the Oil and Gas Conservation Act of 1951, as amended.

4.      That the operators and owners of all wells producing oil or both oil and gas from the "D" sand of the Masters Field should not produce oil from any one well in an amount, during any one month, exceeding a daily average of One Hundred Twenty-five (125) barrels; and should not produce gas from any one well in an amount, during any one month, exceeding a daily average of One Hundred Fifty Thousand (150,000) cubic feet.

5.      That the Masters Field, as used herein, is the area described as:

East Half (E˝) of Section Twenty-three(23) [sic]; the East Half (E˝) of Section Twenty-six (26); all of Sections Twenty-four (24) and Twenty-five (25), Township Five (5) North, Range 61 West of the 6th P.M., Weld County, Colorado; and

The West Half (W˝) of Section Nineteen (19) and the West Half (W˝) of Section Thirty (30), Township Five (5) North, Range 60 West of the 6th P.M., Morgan County, Colorado.

ORDER

IT IS THEREFORE ORDERED, that the operators and owners of all wells producing oil or both oil and gas from the "D" sand of the Masters Field, as hereinabove defined in the Findings, which by reference are made a part hereof, shall not produce oil from any one well in an amount, during any one month, exceeding a daily average of One Hundred Twenty-five (125) barrels; and shall not produce gas from any one well in an amount, during any one month, exceeding a daily average of One Hundred Fifty Thousand (150,000) cubic feet.

IT IS FURTHER ORDERED, that this Order shall be effective fifteen (15) days, commencing December 1, 1954.
