CAUSE NO. 3

ORDER NO. 3-30

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on July 16, 1957, at 10:00 A.M., 330 State Office Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the United States Smelting, Refining and Mining Company for an order granting permission and authority to dually complete its Southern Ute 33-9 #3-16 well, located in the Southeast Quarter of the Southeast Quarter of Section 16, Township 33 North, Range 9 West of the N.M.P.M., La Plata County, Colorado, without commingling in the well bore.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That applicant is the owner of oil and gas leases which cover, among other lands, the Southeast Quarter of the Southeast Quarter (SE/4 SE/4) of Section 16. Township 33 North, Range 9 West of the N.M.P.M., La Plata County, Colorado, and that it has drilled its Southern Ute 33-9 #3-16 well 620 feet from the South section line and 620 feet from the East section line in the above described tract.

4.      That in the drilling of said well, the top of the Dakota formation was encountered at a depth of approximately Seven Thousand Six Hundred Thirty-two (7632) feet, and the top of the Mesaverde formation was encountered at a depth of approximately Four Thousand Seven Hundred Eighteen (4718) feet; and that said well was completed as an open hole Dakota gas well and is now producing from in open hole at depths from Seven Thousand Six Hundred Forty (7640) feet to Seven Thousand Nine Hundred Ten (7910) feet; and that said well is also capable of producing from the Mesaverde formation through casing perforations at various intervals from a depth of Four Thousand Seven Hundred Eighteen {4718) feet to Five Thousand Four Hundred Seventy (5470) feet.

5.      That all available geological and engineering data concerning the Southern Ute 339 #3-16 well indicate that said well can have dual zone completion by perforating at the above intervals opposite the Mesaverde formation, and then settling a Baker Model "D" production packer between the two said horizons and running two-inch (2") tubing through the packer for gas production from the Dakota formation, and running one and one-half (1-1/2) or two (2) inch tubing to a depth of approximately Five Thousand Ninety-four (5094) feet for a siphon string, Gas production from the Mesaverde formation will be through either the annulus or the siphon string, independent and separate without commingling with gas from the Dakota formation.

6.      That the granting of Applicant's request, and the completion and production of said well in the manner hereinabove described, will not result in waste, and that no damage will result to either formation because of such dual zone completion.

ORDER

NOW, THEREFORE, IT IS ORDERED that the following rules and regulations shall apply hereafter to the Southern Ute 33-9 #3-16 well located Six Hundred Twenty (620) feet from the South section line and Six Hundred Twenty (620) feet from the East section line in the Southeast Quarter of the Southeast Quarter (SE/4 SE/4) of Section Sixteen (16), Township Thirty-three (33) North, Range Nine (9) West of the N.M.P.M., La. Plata County, Colorado, in addition to other applicable rules and regulations and orders of this Commission, if any, heretofore adopted and not in conflict herewith.

Gas production from the Mesaverde formation shall be through either the annulus or the siphon string, independent and separate without commingling with gas from the Dakota formation,

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
