IN THE MATTER OF THE PROMULGATION AND ESTABLISHMENT OF FIELD RULES TO GOVERN OPERATIONS IN THE SIDEWINDER FIELD, ARAPAHOE COUNTY, COLORADO Cause No. 277 Order No. 277-6

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on February 20, 1990 at 8:30 a.m., in Room 101, State Education Building, 201 East Colfax, Denver, Colorado, after giving Notice of Hearing as required by law, on the verified application of Petcon Associates, Ltd., for an order to delete certain lands from the spaced area of the Sidewinder Field as established by orders in Cause No. 277.

FINDINGS

The Commission finds as follows:

1. Petcon Associates, Ltd., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4. On November 15, 1982 the Commission amended order No. 277-1 by deleting certain lands from the area established for "D" Sand production in the Sidewinder Field with the below listed lands remaining subject to the provisions of Order No. 277-1: Township 4 South, Range 62 West, 6th P.M. Section 23: S/2 Section 24: W/2 SW/4 Section 25: All Section 26: All

5. Based on the facts stated in the verified application and having been heard by the Hearing Officer who recommends approval of the application, and having received no protests, the Commission should approve the request and amend Order No. 277-5 to delete the SW/4 of the SE/4 of Section 23, Township 4 South, Range 62 West, 6th P.M. from the provisions of Cause No. 277 and which should be made subject to the general rules of the Commission. O R D E R

NOW, THEREFORE, IT IS ORDERED, that the lands described in Finding 4 herein are hereby deleted from the provisions of Order No. 277-1 and shall be subject to the general rules of the Commission. The lands remaining subject to the provisions of Order No. 277-1 shall henceforth include the following:

Township 4 South, Range 62 West, 6th P.M. Section 23: SW/4, NW/4 SE/4, NE/4 SE/4, SE/4 SE/4 Section 24: W/2 SW/4 Section 25: All Section 26: All

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
