IN THE MATTER OF THE PROMULGATION AND ESTABLISHMENT OF FIELD RULES TO GOVERN OPERATIONS IN THE COMANCHE CREEK FIELD, ELBERT COUNTY, COLORADO Cause No. 276 Order No. 276-4

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 20, 1977 at 9 A.M., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Webb Resources, Inc., for an order granting an exception to the well location as established by Order No. 276-1.

FINDINGS

The Commission finds as follows:

1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. That on September 18, 1973, the Commission issued its Order No. 276-1 for the Comanche Creek Field which established 160-acre drilling and spacing units for the production of oil and associated hydrocarbons from the "D" Sand. Each unit con-sists of a governmental quarter section with the permitted well located in the center of the NW/4 of each quarter section with a tolerance of 200 feet for topography or to avoid surface hazards.

4. That evidence presented at the hearing indicates that the drilling unit consisting of the NE/4 Section 13, Township 6 South, Range 63 West, 6th P.M. is located partly outside the pool and is adjacent to a producing unit and the requirement to drill a well at the authorized location would be inequitable or unreasonable. Therefore, an exception should be granted for a well to be drilled at a location in the center of the SE/4 NE/4 of said Section 13 with a tolerance of 200 feet in any direction for topography or to avoid surface hazards, and that it be the permitted well for the unit consisting of the NE/4 of said Section 13.

5. That if a commercial well is drilled on the location as set forth in Finding 4 herein instead of on a location as provided for in Order No. 276-1, the Com-mission should, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling of the well as an exception.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well to be drilled at a location in the center of the SE/4 NE/4 Section 13, Township 6 South, Range 63 West, 6th P.M., Comanche Creek Field, Elbert County, Colorado, with a tolerance of 200 feet in any direction for topography or to avoid surface hazards, and that it be the permitted well for the unit consisting of the NE/4 of said Section 13. How-ever, should a commercial well be drilled at the location as set forth above, the Com-mission shall at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling of the well as an exception.

IT IS FURTHER ORDERED, that the order contained herein shall become effective forthwith.
