CAUSE NO. 26

ORDER NO. 26-6

REPORT OF THE COMMISSION

This cause came on for further hearing before the Commission on April 20, at 10:00 A.M., Room 704, State Capitol Annex, Sherman Street and 14th Avenue, Denver, Colorado, after publication of Notice of Hearing as required by law, on the petition of H.C. Carmack and C.M. Crawford, Jr., to drill two wells off the established spacing pattern, to-wit:

(1)

#1 Arnold,

located in the Center of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of the Southwest Quarter (SW¼) of Section Thirty-three (33), Township Two (2) North, Range Fifty-seven (57) West;

(2)

#1 H. Glenn,

located in the Center of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of the Southwest Quarter (SW¼) of Section Thirty-three (33), Township Two (2) North, Range Fifty-seven (57) West;

both in Morgan County, Colorado.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place, and purpose of the Hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed Order.

3.      That each of the above drilling units are located on the edge of the Adena Field and the same are adjacent to producing units, and that the requirement to drill the wells at the authorized location on the two units would be inequitable or unreasonable.

4.      That exceptions should be allowed for the #1 Arnold well located in the center of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of the Southwest Quarter (SW¼) of Section Thirty-three (33), Township Two (2) North, Range Fifty-seven (57) West, and the #1 H. Glenn well located in the center of the Northwest Quarter (NW¼) of the Southwest Quarter (SW¼) of the Northwest Quarter (NW¼) of Section Thirty-three (33) Township Two (2) North, Range Fifty-seven (57) West; and that each of said wells should be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

ORDER

IT IS THEREFORE ORDERED that the following rules and regulations shall apply hereafter to the lands set forth in this Order, in addition to other applicable rules, regulations, and orders of the Commission heretofore adopted and not in conflict herewith.

IT IS FURTHER ORDERED that exceptions shall be granted for the #1 Arnold well located in the center of the Northwest (Quarter (NW¼) of the Northwest Quarter (NW¼) of the Southwest Quarter (SW¼) of Section Thirty-three (33), Township Two (2) North, Range Fifty-seven (57) West, and the #1 H. Glenn well located in the center of the Northwest Quarter NW¼ of the Southwest Quarter (SW¼) of the Northwest Quarter (NW¼) of Section Thirty-three (33), Township Two (2) North, Range Fifty-seven (57) West; and that each of said wells shall be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

IT IS FURTHER ORDERED that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above rules and regulations.

ORDERED this 6th day of May, 1954, by the Oil and Gas Conservation Commission of the State of Colorado.
