CAUSE NO. 26

ORDER NO. 26-39      (Emergency)

REPORT OF THE COMMISSION

The Oil and Gas Conservation Commission of the State of Colorado has heretofore established forty-acre drilling and spacing units in the Adena Field, Morgan County, Colorado, by its Order No. 26-1, subsequently amended as to field limits. On June 4, 1958, the Harwood Oil & Mining Company stated to the Commission that an emergency existed, and requested permission to drill a well off the established spacing pattern.

FINDINGS

The Commission finds as follows:

1.      That the Commission has jurisdiction to promulgate the prescribed order.

2.      That an emergency exists which requires immediate action and a modification of existing orders in the Adena Field insofar as they pertain to the drilling of a well in the Center of the Northwest Quarter of the Southeast Quarter of Section 2, Township 1 North, Range 58 West, 6th P.M; and that an Emergency Order be issued in accordance with the provisions of 100-6-7(3) of the Colorado Oil and Gas Conservation Act for the drilling of said well.

3.      That a dry hole has been drilled in the Center of the Southeast Quarter of the Northwest Quarter of the Southeast Quarter of Section 2, Township 1 North, Range 58 West, 6th P.M., in accordance with the provisions of Order No. 26-1, as amended.

4.      That Applicant states that geological and geophysical data seem to indicate that the Center of the Northwest Quarter of the Southeast Quarter ( NW¼ SE¼) of Section Two (2), Township One (1) North, Range Fifty-eight (58) West, 6th Morgan County, Colorado, would be the proper location in which to drill a test well.

5. That the Commission has contacted all lease owners of offset contiguous drilling units, and found no objection to the drilling of a well at the location described in Finding 4 above.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception shall be granted for a well to be drilled 1980 feet from the south line, and 1980 feet from the east line, in the Center of the Northwest Quarter of the Southeast Quarter (C NW¼ SE¼) of Section Two (2), Township One (1) North, Range Fifty-eight (58) West of the 6th P. M., Morgan County, Colorado, and that said well shall be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

IT IS FURTHER ORDERED, that this order shall be effective fifteen (15) days [sic], commencing June 5, 1958.
