CAUSE NO. 26

ORDER NO. 26-3        (Emergency)

REPORT OF THE COMMISSION

The Oil and Gas Conservation Commission of the State of Colorado has been closely observing the production of oil and gas from the "D" and "J" sands of the Adena Field in Morgan County, Colorado. This field contains oil and gas now in production, and the Commission has heretofore, upon application, notice, and hearing, established drilling and spacing rules in said "D" and "J" sands of the said Adena Field.

FINDINGS

The Commission finds as follows:

1.      That the Commission has jurisdiction to promulgate the hereinafter prescribed Order.

2.      That, in accordance with the provisions of Sections Four (4) and Five (5) of the Oil and Gas Conservation Act of 1951, as amended, there is being committed in the Adena Field underground waste, inefficient, excessive or improper use or dissipation of reservoir energy, and the escape, blowing or releasing, directly or indirectly, into the open air, of gas from wells producing oil or both oil and gas; and that there is being committed in the Adena Field, the production of gas in quantities or in such manner as is unreasonably reducing reservoir pressures or unreasonably diminishing the quantity of oil or gas that might ultimately be produced.

3.      That an emergency exists which requires immediate action and requires the immediate promulgation of upper limits upon the production of gas for all wells producing oil or both oil and gas in the Adena Field, in order to prevent and avoid waste, as that term is defined in the Oil and Gas Conservation Act of 1951, as amended, and in order to conserve oil and gas and to secure the greatest ultimate recovery of oil and gas from the Adena Field; and that an Emergency Order should be issued, in accordance with the provisions of Section 8 (c) of the Oil and Gas Conservation Act of 1951, as amended.

4.      That the operators and owners of all wells producing oil or both oil and gas from the "D" and "J" sands of the Adena Field should not produce gas from any one well in an amount, during any one month, exceeding a daily average of One Hundred Fifty Thousand (150,000) cubic feet.

That the Adena Field, as used herein, is that area in the West half (W½) of Section Four (4), Sections Five (5), Six (6), Seven (7), and Eight (8), the West half (W½) of Section Nine (9), West half (W½) of Section Sixteen (16), Sections Seventeen (17), Eighteen (18), Nineteen (19), and Twenty (20), the West half of Section Twenty-one (21), Northwest Quarter (NW¼) of Section Twenty-eight (28), North half (N½) of Section Twenty-nine (29), North half (N½) of Section Thirty (30), all in Township One (1) North, Range Fifty seven (57) West; Sections One (1), Two (2), Three (3), Ten (10), Eleven (11), Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), Twenty-two (22), Twenty-three (23), and Twenty four (24), all in Township One (1) North, Range Fifty-eight (58) West; the West half (W½) of Section Twenty-eight (28), Sections twenty-nine (29), Thirty (30), Thirty-one (31), Thirty-two (32) , the West half (W½) of Section Thirty-three (33) in Township Two (2) North, Range Fifty-seven (57) West; Sections Twenty-five (25), Twenty-six (26), Twenty-seven (27), Thirty-four (34), Thirty five (35), and Thirty-six (36), all in Township Two (2) North, Range Fifty-eight (58) West, Morgan County, Colorado.

ORDER

IT IS THEREFORE ORDERED, that the operators and owners of all wells producing oil or both oil and gas from the "D" and "J" sands of the Adena Field shall not produce gas from any one well in an amount, during any one month, exceeding a daily average of One Hundred Fifty Thousand (150,000) cubic feet.

IT IS FURTHER ORDERED, that this Order shall be effective fifteen (15) days, commencing April 1, 1954.
