ORDER NO. 26-2

 

REPORT OF THE COMMISSION

 

This cause came on for further hearing before the Commission on March 2, 1954, at Ten o'clock A.M., Room 704, State Capitol Annex, Sherman Street and 19th Avenue, Denver, Colorado, after publication of Notice of Hearing as required by law, on the petitions of Petroleum, Inc., for an extension of the Adena Field to include Sections Twenty-five (25), Twenty-six (26), Twenty-seven (27), Thirty-four (34), Thirty-five (35), and Thirty-six (36), Township Two (2) North, Range Fifty-eight (58) West, Morgan County, Colorado; and upon the petition of McElroy Ranch Company to drill one well of the established spacing pattern, towit [sic]:  No. 1 Van Tuyl located in the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of Section Four (4), Township One (1) North, Range Fifty-seven (57) West; and upon Commission's own motion to include Sections Twenty-eight (28), Twenty-nine (29), Thirty (30), West half (W½) of Thirty-one (31), East half (E½) of Thirty-three (33), Township Two (2) North, Range Fifty-seven (57) West; East half (E½) of Section Four (4), East half (E½) of Section Nine (9), East half (E½) of Section Sixteen (16), East half (E½) of Section Twenty-one (21), Northeast Quarter (NE¼) of Section Twenty-eight (28), Township One (1) North, Range fifty-seven (57) West of the Sixth Principal Meridian, Morgan County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place, and purpose of the Hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said notice and of the p

arties interested therein, and jurisdiction to promulgate the hereinafter prescribed Order.

 

3.      That the D" and "J" sand formations of the Dakota Series in the Adena Field constitute common sources of supply underlying, in addition to the area set forth in Causes No. 26 and 27, Order No. 1, the following described lands in Morgan County, Colorado:

 

Sections Twenty-five (25), Twenty-six (26), Twenty-seven (27), Thirty-four (34), Thirty-five (35), and Thirty-six (36), Township Two (2) North, Range Fifty-eight (58) West; West half (W½) of Section Twenty-eight (28), all of Section Twenty-nine (29) and Thirty (30), and West half (W½) of Section Thirty-one (31), Township Two (2) North, Range Fifty-seven (57) West of the Sixth principal [sic] Meridian, Morgan County Colorado,

 

4.      That an exception should be allowed for the No. 1 Van Tuyl located in the center of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of Section Four (4), Township One (1) North, Range Fifty-seven (57) West; and that said well should be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

 

5.      That Causes No. 26 and 27 should be joined and hereafter referred to as Cause No. 26.

 

ORDER

 

IT IS THEREFORE ORDERED, that the following rules and regulations shall apply hereafter to the lands set forth in this Order, and to those lands set forth in Causes No. 26 and 27, Order No. 1, referred to as the Adena Field, in Morgan County, Colorado, in addition to other applicable rules, regulations, and orders of the Commission heretofore adopted and not in conflict herewith.

 

Rule 1.    That Causes No. 26 and 27 shall be joined and hereafter known as Cause No. 26.

 

Rule 2.    That all the rules, regulations and orders of this Commission as set forth in Cause No. 26 shall be and the same are hereby established for the production of oil and gas from the "D" and "J" sands of the Dakota Series, common sources of supply underlying the additional lands described as follows:

 

Sections Twenty-five (25), Twenty-six (26), Twenty-seven (27), Thirty-four (34), Thirty-five (35), and Thirty-six (36), Township Two (2) North, Range Fifty-eight (58) West; West half (W½) of Section Twenty-eight (28), all of Sections Twenty-nine (29) and Thirty (30), and West half (W½) of Section Thirty-one (31), Township Two (2) North, Range Fifty-seven (57) West of the Sixth Principal Meridian, Morgan County, Colorado.

 

IT IS FURTHER ORDERED, that an exception shall be granted for the No. 1 Van Tuyl located in the center of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of the Northwest Quarter (NW¼) of Section Four (4), Township One (1) North, Range Fifty-seven (57) West, which shall be the permitted oil or gas well for the unit upon which it is located.

 

IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of any well or wells in the "D" and "J" sand formations of the Dakota Series for the purpose of producing oil and gas therefrom, at a location other than authorized by Order No. 1, Cause No. 26, and by this Order, is hereby prohibited.

 

IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above rules and regulations.
