ORDER NO. 26-10

 

REPORT OF THE COMMISSION

 

This Cause came on for further hearing before the Commission on June 3, 1954, at 10: A.M., Room 704, State Capitol Annex, Sherman Street and 14th Avenue, Denver, Colorado, after Notice of Hearing and Waiver of Service, as required by law, on the petition of the United States Smelting, Refining and Mining Company, to drill two wells off the established spacing pattern, to-wit:

Howard Glenn Well No. 3 - located in the Center of the Northwest Quarter of the Southwest Quarter of the Southeast Quarter (NW¼SE¼SE¼) of Section Thirty-two (32), Township Two (2) North, Range Fifty-seven (57) West of the Sixth (6th) P.M., Morgan County, Colorado.

Howard Glenn Well No. 4 - located in the Center of the Northwest Quarter of the North-east Quarter of the Southeast Quarter of Section Thirty-two (32), Township Two (2) North, Range Fifty-seven (57) West of the Sixth (6th) P.M., Morgan County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place, and purpose of the Hearing has been given in all respects, as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed Order.

 

3.      That both of the above drilling units are located adjacent to producing units, and that the requirement to drill the wells at the authorized location on the two units would be inequitable or unreasonable.

 

4.      That exceptions should be allowed for the Howard Glenn Well No. 3, located in the Center of the Northwest Quarter of the Southwest Quarter of the Southeast Quarter (NW¼SW¼SE¼) of Section Thirty-two (32), Township Two (2) North, Range Fifty-seven (57) West of the Sixth (6th) P.M.; and for the Howard Glenn Well No. 4, located in the Center of the Northwest Quarter of the Northeast Quarter of the Southeast Quarter (NW¼NE¼SE¼) of Section Thirty-two (32), Township Two (2) North, Range Fifty-seven (57) West of the Sixth (6th) P.M., both in Morgan County, Colorado; and that each of said wells should be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

 

ORDER

 

IT IS THEREFORE ORDERED, that the following rules and regulations shall apply hereafter to the lands set forth in this Order, in addition to other applicable rules, regulations, and orders of the Commission heretofore adopted and not in conflict herewith:

 

Rule 1.    That an exception shall be granted for the Howard Glenn Well No. 3, located in the Center of the Northwest Quarter of the Southwest Quarter of the Southeast Quarter (NW¼SW¼SE¼) of Section Thirty-two (32), Township Two (2) North, Range Fifty-seven (57) West of the Sixth (6th) P.M., in Morgan County, Colorado, and that said well shall be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

 

Rule 2.    That an exception shall be granted for the Howard Glenn Well No. 4, located in the Center of the Northwest quarter of the Northeast Quarter of the Southeast Quarter (NW¼NE¼SE¼) of Section Thirty-two (32), Township Two (2) North, Range Fifty-seven (57) West of the Sixth (6th) P.M., in Morgan County, Colorado, and that said well shall be the permitted oil or gas well for the drilling and spacing unit upon which it is located.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above rules and regulations.
