REPORT OF THE COMMISSION

 

This cause came on for hearing Before the Commission on June 15, 1971, at 9 A.M., in Room 132, State Services Building, 1525 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Amoco Production Company, which application was amended at the hearing to delete from the lands to be added, Sections 25 through 36, Township 2 South, Range 65 West and the N/2 of Township 2 South, Range 66 West, 6th P.M., for an order extending the limits of the Wattenberg Field, hereafter to be known as the Wattenberg Gas Spaced Area, and establishing for the additional area, 320-acre drilling and spacing units for the production of gas and associated hydrocarbons from the "J" Sand as provided for in Order Nos. 232-1 and 232-2.

 

FINDINGS

 

        The Commission finds as follows:

 

1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3. That testimony presented at the hearing indicates a common source of supply of gas and associated hydrocarbons underlies, in addition to the area set forth in Order Nos. 232-1 and 232-2, the following described lands in Adams and Weld Counties, Colorado, to-wit:

and that such area should be made subject to the provisions of Order Nos. 232-1and 232-2.

4. That since there was conflicting evidence presented at the hearing as to whether the same common source of supply in the Wattenberg Area extended into the area described as Sect ions l through 24, Township 2 South, Range 65 West and Sections 19 through 36, Township 1 South, Range 65 West, 6th P.M., the location of the permitted well for the 320-acre drilling unit should be made more flexible than that allowed for in the Wattenberg Spaced Area in order to promote further exploration in this area, and that the Director should be allowed to approve exceptions, without notice and hearing, to the permitted well locations, provided the owners of the contiguous and cornering drilling units file a waiver or consent in writing agreeing to said exceptions.

5. That all wells drilled and all locations in the area described in Findings 3 & 4 herein, approved by the Commission prior to the date of filing the Application, which was May 14, 197 1, should be considered exceptions and be the permitted wells or locations for the drilling units upon which they are located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the area set forth in Findings 3 and 4 herein shall be subject to the provisions of Order Nos. 232-1 and 232-2, and the Wattenberg Gas Spaced Area shall henceforth include the following described lands in Adams and Weld Counties, Colorado, to-wit:

and henceforth such area shall be known as the Wattenberg Gas Spaced Area.

        IT IS FURTHER ORDERED that the wells drilled and locations made in the area described in Findings 3 and 4 herein, and approved by the Commission prior to May 14, 1971, shall be considered exceptions and be the permitted wells or locations for the drilling units upon which they are located.

        IT IS FURTHER ORDERED that in order to promote further exploration in the area described as Sections 19 through 36, Township 1 South, Range 65W., and Sections 1 through 24, Township 2 South, Range 65W, 6th P.M., the Director may, without additional notice and hearings, grant exceptions to the permitted well location in this area provided the owners of the contiguous and cornering drilling units file a waiver or consent in writing agreeing to said exceptions.

        IT IS FURTHER ORDERED that the Commission expressly reserves the right, after notice and hearing, to alter, amend or repeal any part of or all of the above orders.
