CAUSE NO. 230

ORDER NO. 230-3

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on July 20, 1981 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Texas Oil and Gas Corporation, for an order to amend Order No. 230-1 to reduce the spacing for gas from the "D" Sand to 160-acre units and to establish 40-acre drilling and spacing units for the production of oil from the "D" Sand.  It was further requested that production be limited to a daily maximum allowable of 500 MCF [sic] from a gas well on each 160-acre unit and 300 MCF [sic] of gas from an Oil [sic] well.  In addition, a well completed in the "D" Sand reservoir with a gas/oil ratio greater than 15,000, or the liquid hydrocarbons with a specific gravity greater than 50° A.P.I. should be designated a gas well.

FINDINGS

The Commission finds as follows:

1.      Texas Oil and Gas Corporation, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4.      Insufficient evidence was submitted at the hearing to determine, at this time, the proper spacing and the most efficient production practice for the field.  Additional data should be presented by the operators in the field at the hearing scheduled for September 21, 1981, in order for the Commission to make the proper determination in this matter.

5.      In order to prevent waste, as that term is defined in the Oil and Gas Conservation Act, no flaring of gas should be allowed, and until the scheduled September, 1981 hearing, a production limitation should be placed on the existing wells in the spaced area (as described in the following order) as follows:
