ORDER NO. 230-2

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on April 20, 1981 at 9:00 A.M., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Beren Corporation, for an order granting an exception to the spacing pattern as established by Order No. 230-1 for the Sooner Field, Weld County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Beren Corporation, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On October 26, 1970 the Commission issued Order No. 230-1 for the Sooner Field which established 320-acre drilling and spacing units for the production of gas from the "D" Sand.  Drilling units consist of the E½ and W½ or the N½ and S½ of each section.  The permitted well for each unit is at a location in the center of the NW¼ and the SE¼ of each section with a tolerance of 150 feet in any direction for surface hazards or obstructions.  A well, the No. 1 Duncan-Federal was drilled at a location 1980 feet from the north line and 660 feet from the east line of Section 32, Township 8 North, Range 58 West, 6th P.M., for production of oil from a separate "D" Sand reservoir; however, the well was completed for production of gas and associated hydrocarbons from the "D" Sand reservoir spaced by said Order No. 230-1 and the well is therefore off-pattern.

 

5.      An application was filed with the Commission requesting that said well, No. 1 Duncan-Federal drilled at an off-pattern location to the requirements of Order No. 230-1, be allowed to produce the gas and associated hydrocarbons from the "D" Sand reservoir, and that it be considered the permitted well for the unit consisting of the N½ of said Section 34.

 

6.      The allegations in said application are true and should be adopted as the finding of the Commission, and all known offset owners and interested persons were given proper Notice of Hearing and no objections to the application were received.  Therefore, the request should be granted.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception to the spacing pattern established by Order No. 230-1 for the Sooner Field, Weld County, Colorado, is hereby granted for Well No. 1 Duncan-Federal drilled at a location 1980 feet from the north line and 660 feet from the east line, Section 34, Township 8 North, Range 58 West, 6th P.M., and that production of gas and associated hydrocarbons from the "D" Sand reservoir is hereby allowed and that said well be the permitted well for the unit consisting of the N½ of said Section 34.

 

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
