                                                             REPORT OF THE COMMISSION

 

                        This cause came on for hearing before the Commission on November 15, 1993 in Room 318, State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing, as required by law on the application of Elk Exploration, Inc., for an  for an order to rescind all orders in Cause No. 229 in effect for Section 5, Township 2 South, Range 64 West, 6th P.M.

 

                                                                                 FINDINGS

 

                        The Commission finds as follows:

 

                        1.  Elk Exploration, Inc., as applicant herein, is an interested party in the subject matter of the above‑referenced hearing.

 

                        2.  Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

                        3.  The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

                        4.  In Order No. 229-1 issued September 15, 1970, the Commission established 80-acre drilling and spacing units for the production of oil from the "D" Sand Formation, including Section 5, Township 2 South, Range 64 West, 6th P.M.  Order No. 229-2 issued May 18, 1971 amended Order No. 229-1 and established 80-acre drilling and spacing units for production from the "J" Sand Formation for the Jamboree Field.  Said units consist of the E1/2 and the W1/2 or the N1/2 and the S1/2 of each quarter section, with the permitted well for each unit located in the center of the NE1/4 and the SW1/4 of each quarter section, with a tolerance of 200 feet in any direction.  In addition, the order allowed the downhole commingling of production from the "D" Sand Formation with production from the "J" Sand Formation, for the below-listed lands in Adams County, Colorado:

 

                                                  Township 1 South, Range 64 West, 6th P.M.

                                                                 Sections 20 through 23:  All               

                                                                 Sections 26 through 29:  All

                                                                 Sections 32 through 35:  All

 

                                                  Township 2 South, Range 64 West, 6th P.M.

                                                                   Sections 2 through 5:  All                  

 

                        5.  Order No. 229-8 issued May 18, 1992 approved the request to allow a well to be drilled at an exception location in the NW1/4 SW1/4 of Section 5, Township 2 South, Range 64 West, 6th P.M. for commingled production from the "D" Sand and "J" Sand Formations.  Said well was drilled as a dry hole by Energy Minerals Corporation.

 

                        6.  That evidence presented at the hearing indicates that there are two separate reservoirs for the "D" Sand Formation in the Jamboree Field.

 

                        7.  Based on the facts stated in the application, receiving no protests, having been heard by the Hearing Officer on November 11, 1993, and recommended for approval, the Commission should enter an order rescinding all orders in Cause No. 229 in effect for Section 5, Township 2 South, Range 64 West, 6th P.M. and placing the subject lands under the provisions of the Rules and Regulations of the Oil and Gas Conservation Commission.

 


                                                                                   ORDER

 

                        NOW, THEREFORE, IT IS ORDERED, that, all orders in Cause No. 229 in effect for Section 5, Township 2 South, Range 64 West, 6th P.M. are hereby rescinded and the subject lands are placed under the provisions of the Rules and Regulations of the Oil and Gas Conservation Commission.  The below-described lands shall remain subject to the provisions of Cause No. 229:

 

                                                  Township 1 South, Range 64 West, 6th P.M.

                                                                 Sections 20 through 23:  All

                                                                 Sections 26 through 29:  All

                                                                 Sections 32 through 35:  All

 

                                                  Township 2 South, Range 64 West, 6th P.M.

                                                                   Sections 2 through 4:  All                  

 

                        IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

 

                        IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
