ORDER NO. 226-21, 233-6

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 21, 1990 at 8:30 a.m., in Room 101, State Education Building, 201 East Colfax, Denver, Colorado, after giving Notice of Hearing as required by law, on the motion of the Commission to delete certain lands in the Peoria Field previously established in Cause No. 226 for the production of gas and oil from the Muddy "J" formation and certain lands in Peoria North Field established in Cause No. 233 for the production of oil and associated hydrocarbons from the Muddy "J" formation, and that such lands should be subject to the Rules and Regulations of the Commission for any further development of the Muddy "J" formation.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on May 19, 1970, the Commission issued order No. 226-1 which established 320-acres drilling and spacing units for the production of gas from the Muddy "J" formation underlying the following described lands in Arapahoe County, Colorado, to-wit:

 

Township 4 South, Range 60 West, 6th P.M.

Sections:  9, 10, 11, 12, 13, 14, 15, 16, 21, 22, 23, 24, 25, 26, 27, 28, 29, 33, 34, 35, 36

 

4.      That on February 16, 1971, the Commission issued Order No. 226-8 which established 80-acre drilling and spacing units for the production of oil from the Muddy "J" formation underlying the following described lands in Arapahoe County, Colorado, to-wit:

 

Township 4 South, Range 60 West, 6th P.M.

Sections:  19, 20, 21, 22 (S1/2), 27, 28, 29, 30, 31, 32, 33, 34

 

Township 4 South, Range 61 West, 6th P.M.

Sections:  24, 26, 36

 


 

Township 5 South, Range 60 West, 6th P.M.

Sections:  3, 4, 5, 6, 8, 9, 10

 

Township 5 South, Range 61 West, 6th P.M.

5.      That on August 15, 1983, The Commission issued Order No. 233-5 which amended order No. 233-1 by deleting certain lands from those previously established for the production of oil and associated hydrocarbons from the "J" Sand.  The provisions of Cause No. 233 established 80-acre drilling and spacing units which consist of the E1/2 and W1/2 or the N1/2 and S1/2 of each quarter section with the permitted well located in the center of the NE1/4 and SW1/4 of each quarter section with a tolerance of 200 feet for the below listed lands:

6.      That only limited exploration and development has occurred outside the Peoria Unit area with three wells currently capable of production from the Muddy "J" Sand.

 

7.      That several current operators and mineral interest holders have requested that the Commission review the need for the existing orders and that no protests to the application have been received.

 

8.      That the Commission should delete the below listed lands from the provisions of Order Nos. 226-1 and 226-8 and Order No. 233-3 as applicable for the Muddy "J" Sand formation and that such lands should be subject to the Rules and Regulations of the Commission, to-wit:

ORDER

NOW, THEREFORE, IT IS ORDERED, that the lands listed in Finding 8 hereinabove are deleted from the provisions of order Nos. 226-1 and 226-8 and Order No. 233-3 as they pertain to the development of the Muddy "J" Sand underlying said lands and henceforth are subject to the Rules and Regulations of the Commission.

 

IT IS FURTHER ORDERED, that the following lands remain under the provisions of order No. 233-3, to-wit:

IT IS FURTHER ORDERED, that the following lands remain under the provisions of Order No. 226-8:

and that all lands embraced within the Peoria Unit approved by Order No. 226-17 remain under the provisions of said Order No. 226-17.

 

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
