CAUSE NO. 226

ORDER NO. 226-20

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on April 17, 1978 at 9 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion, to consider Well No. 5 Price, located in the NE¼SW¼ Section 14, Township 4 South, Range 60 West, 6th P.M. as the permitted well for the unit upon which it is located in place of Well No. 1 Price, located in the SW¼SW¼ of said Section 14.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That on May 19, 1970, the Commission issued its Order No. 226-1 for the Peoria Field which, among other things, established the Well No. 1 Price, located in the SW¼SW¼ Section 14, Township 4 South, Range 60 West, 6th P.M. as the permitted well for the 320-acre drilling and spacing unit upon which it is located (the S½ of said Section 14).

4.      That testimony presented at the hearing indicates said Well No. 1 Price has since been tested and re-classified as an oil well and Well No. 5 Price, drilled at a location in the NE¼SW¼ of Section 14, Township 4 South, Range 60 West, 6th P.M. has been completed as a gas well in the "J" Sand and should be considered the permitted well for the unit upon which it is located as an exception to Order No. 226-1.

ORDER

NOW, THEREFORE, IT IS ORDERED, that Well No. 5 Price, located in the NE¼SW¼ Section 14, Township 4 South, Range 60 West, 6th P.M., shall be considered an exception to Order No. 226-1 and be the permitted well for the production of gas from the "J" Sand underlying the drilling and spacing unit consisting of the S½ of said Section 14.

IT IS FURTHER ORDERED, that the above order shall become effective forthwith.

ORDERED this 17th day of April, 1978.
