ORDER NO. 220-1

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on October 21, 1969, at 10 a.m., in Conference Room 260, Columbine Building, 1845 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of W.W. Garber, for an order granting an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission of the State of Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the testimony presented at the hearing indicates that since Section 22, Township 12 North, Range 53 West, 6th P.M. is a fractional section and because of the proximity of the well site to the State boundary, and in order to protect correlative rights, an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission should be granted for a well to be drilled in the approximate center of the E½ of Lot 1 of Section 22, Township 12 North, Range 53 West, 6th P.M., Logan County, Colorado; said well to be located 355 feet from the north line and 660 feet from the east line of said Section 22.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that an exception shall be granted for a well to be drilled in the approximate center of the E½ of Lot 1 of Section 22, Township 12 North, Range 53 West, 6th P.M., Logan County, Colorado, that said well be located 355 feet from the north line and 660 feet from the east line of said Section 22; however, if a commercial well is drilled on the location set forth above instead of on a location as provided in Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission of the State of Colorado, the Commission shall, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling of the well as an exception.
