REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on April 18, 1983 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of James D. Kliesen, William D. Kliesen and Pintail Petroleum, Ltd. for approval to use Well No. 1. Kliesen, located in the NW1/4NW1/4 Section 6, Township 14 South, Range 44 West, 6th P.M., Cheyenne Wells Field, Cheyenne County, Colorado, as a water disposal well into the Osage formation.

 

FINDINGS

 

The Commission finds as follows:

 

1.      James D. Kliesen, William D. Kliesen and Pintail Petroleum, Ltd., as applicants herein, are interested parties in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On January 21, 1983, James D. Kliesen, William D. Kliesen and Pintail Petroleum, Ltd., filed with the Commission an application pursuant to Rule 330 of the Rules and Regulations for approval to use Well No. 1 Kliesen, located in the NW1/4NW1/4 Section 6, Township 14, South, Range 44 West, 6th P.M., Cheyenne Wells Field, Cheyenne County, Colorado, as a water disposal well in the Osage formation.  Objections to the granting of the application were received by the Commission.

 

5.      Evidence presented at the hearing was insufficient for the Commission to make a determination that disposal of water into the Osage formation would be injurious to existing and potential hydrocarbon bearing zones.  However, approval should be granted to use said Well No. 1 Kliesen as a water disposal well into the Osage formation, approval to take effect sixty (60) days from the date of this hearing unless additional geological evidence is presented to the Commission as a result of drilling any additional wells in the area.

 

6.      The hearing should be continued to the June 27, 1983 hearing date, at which time this order should become final, unless fifteen (15) days prior to the date of the hearing, upon notice to the Director, additional geological information is to be presented to the Commission concerning this matter.

 


 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the application requesting authority to dispose of produced water into the Osage formation by use of Well No. 1 Kliesen, located in the NW1/4NW1/4 Section 6, Township 14 South, Range 44 West, 6th P.M., Cheyenne Wells Field, Cheyenne County, is hereby approved subject to the following:

 

1.      Hearing in the matter shall be continued to the June 27, 1983 hearing date, at which time approval shall become effective unless additional geological evidence, based on additional drilling and development in the area is to be presented to the Commission.

 

2.      Notice shall be given to the Director fifteen (15) days prior to the date of hearing if such additional geological evidence is to be presented to the Commission.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal the above order.
