ORDER NO. 21-14

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on January 16, 1990 at 10:00 a.m., at the La Plata County Extension Building, 2500 North Main Avenue, Durango, Colorado, after giving Notice of Hearing as required by law, on the verified application of VisopOil to rescind Orders No. 21-4 and 21-5 which established rules for the operation of the Badger Creek "D" Sand Unit in Badger Creek Field, Adams County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That VisopOil, as applicant herein, is an interested in the subject matter of the above-referenced hearing.

 

2.      That due notice, of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, jurisdiction to promulgate the hereinafter prescribed order.

 

4.      That on June 17, 1958 the Commission authorized Order 21-4 to be issued which established a pressure maintenance operation production from the "D" Sand reservoir underlying parts of the Badger Creek Field.  On July 21, 1959 the Commission authorized Order No. 21-5 be issued which approved a certain Royalty Owners's [sic] Unitization Agreement including provisions for Unit Operations for the "D" Sand underlying parts of the Badger Creek Field.

 

5. VisopOil, as successor-in-interest to Sinclair Oil and Company, original operator of said "D" Sand Unit, filed with the Commission a Termination of Unit for the Badger Creek "D" Sand Unit of Badger Creek Field, also known as the Causey "D" Sand Unit of the Badger Creek Field, said unit covering the following described lands in County, Colorado, to-wit:

 

Township 2 South, Range 57 West, 6th P.M.

Section 14:  All

Section 15:  All

Section 22:  All

Section 23:  All

Section 27:  N/2, E/2 SW/4, W/2 SE/4

 

6.      That Order No.s [sic] 21-4 and 21-5 should be rescinded and the lands described herein above should be governed by the general and regulations of the Commission.


 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order Nos. 21-4 and 21-5 are hereby rescinded and the lands described herein above shall be governed by the general rules and regulations of the Commission including rules pertaining to the disposal and injection of produced fluids.

 

IT IS FURTHER ORDERED, that the above order shall become effective forthwith.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal and/or all of the above orders.
