ORDER NO. 21-13

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on November 17 1964, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Sinclair Oil & Gas Company for an order vacating the provisions of Order No. 21-1, as amended, only as they pertain to the "J" sand formation underlying certain lands in the Badger Creek Field, and substituting in lieu thereof the provisions of general rules and regulations of the Commission.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on September 8, 1953, the Commission issued its Order No. 21-1 establishing 20-acre drilling and spacing units for the "D" and "J" sand formations underlying the Badger Creek Field.

 

4.      That the "J” sand formation constitutes a separate common source of supply underlying the following described lands in the Badger Creek Field, Adams County, Colorado, to-wit:

 

Township 2 South, Range 57 West 6th P.M.

S½, SE¼NE¼

Section 16:

Section 21:

E½NE¼, NE¼SE¼

Section 22:

N½, N½S½

Section 23:

NW¼NW¼

 

5.      That all engineering and geological testimony presented at the hearing indicates that in order to more fully develop and exploit the "J" sand formation in the above described area, operators should be permitted to drill wells at the most advantageous locations, and that the provisions of said Order No. 21-1, as amended, should be vacated only as they pertain to said "J" sand formation, and that the provisions contained in the general rules and regulations of the Commission should be substituted in lieu thereof.

 

6.      That the secondary recovery operations for the "D" sand formation underlying the Badger Creek Field will not be adversely affected by such operations in said "J" sand formation.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that the provisions of Order No. 21-1, as amended, shall be and they hereby are vacated only as they pertain to the "J" sand formation, separate common source of supply underlying the following described lands in the Badger Creek Field: Adams County, Colorado, to-wit:

Section 21:

E½NE¼, NE¼SE¼

Section 22:

and that the provisions contained in the general rules and regulations of the Commission shall be substituted in lieu thereof.

 

IT IS FURTHER ORDERED, that the locations of all wells drilled previous to this order in the "J" sand formation underlying the above described lands shall be allowed and shall not be held in conflict with Rule 316 of this Commission Rules and Regulations.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
