REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 18, 1974 at 9 a.m., in Room 132 State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Norval W. Robison, Carol and John H. Robison, V.H. Simmons, Jr., Milton V. Stenseth and Mabel G. Stenseth, for an order pooling all tracts of land within the designated unit consisting of Section 34, Township 2 North, Range 60 West, 6th P.M., Roundup Field, Morgan County, Colorado, and in addition to determine whether said pooling should be on the basis of 7/8ths of 1/8th, or on the basis of 8/8ths of 1/8th.  V.H. Simmons, Jr., Milton V. Stenseth and Mabel G. Stenseth withdrew as applicants and hearing in the matter concerning the remaining applicants, Norval W. Robison, Carol and John H. Robison, was further continued each month until the February 18, 1975 hearing date.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That since the remaining applicants do not appear ready to proceed with the hearing, and further continuance would serve no useful purpose, the application should be dismissed without prejudice.

ORDER

NOW, THEREFORE, IT IS ORDERED, that since the remaining applicants do not appear ready to proceed with the hearing, and further continuance would serve no useful purpose, the application filed May 13, 1974 for an order pooling all interests within the designated unit consisting of Section 34, Township 2 North, Range 60 West, 6th P.M., Roundup Field, Morgan County, Colorado, is hereby dismissed without prejudice.
