CAUSE NO. 204

ORDER NO. 204-1

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on May 16, 1967, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of appropriate waivers of service thereof, on the application of Cardinal Petroleum Company for an order granting an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission, for a well to be drilled in the center of the NW¼SW¼SE¼ of Section 21, Township 2 North, Range 58 West, 6th P.M., Morgan County, Colorado.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That geological and engineering testimony presented at the hearing indicates that the SW¼SE¼ of Section 21, Township 2 North, Range 58 West, 6th P.M., Morgan County, Colorado, is located partly outside the "D" sand pool and is adjacent to a producing tract; and that, therefore, in order to protect correlative rights, an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission should be granted for a well to be drilled in the center of the NW¼SW¼SE¼ of said Section 21, said well to be located no closer than 330 feet from the west line and 990 feet from the south line of the SW¼SE¼ of said Section 21.

4.      That in order to determine the allowed rate and amount of production from said well, the operators should be requested to core the well during drilling, and to supply a copy of the analysis of such core to the Office of the Commission; and that operators may run casing and test such well, but that no production should be allowed until the Commission determines the rate of production, based on information received from the drilling of said well.

ORDER

NOW, THEREFORE, IT IS ORDERED that an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission of the State of Colorado shall be granted for a well to be drilled in the center of the NW¼SW¼SE¼ of Section 21, Township 2 North, Range 58 West of the 6th P.M., Morgan County, Colorado, said well to be located no closer than 330 feet from the west line and 990 feet from the south line of the SW¼SE¼ of said Section 21.

IT IS FURTHER ORDERED, that the operators are hereby requested to core said well during drilling, and to supply a copy of the analysis of such core to the office of the Commission.  Operators may run casing and test such well, but no production shall be allowed until the Commission determines the rate of production, based on information obtained from the drilling of said well.

IT IS FURTHER ORDERED, that the provisions contained in the above orders shall become effective forthwith.

ORDERED this 16th day of May 1967.
