ORDER NO. 201-2

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 21, 1967, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of appropriate waivers of service thereof, on the application of R. G. Boekel for an order granting an exception to the spacing pattern established by Order No. 201-1 for a well to be drilled in the center of the NEĽNEĽ of Section 12, Township 2 North, Range 93 West, 6th P.M., Rio Blanco County, Colorado, with an allowed tolerance of 200 feet in any direction.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That, due notice of the time place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That geological and engineering testimony presented at the hearing indicates that a well drilled in accordance with the established spacing pattern would be non-productive.

 

4.      That in order to protect correlative rights, an exception to Order No. 201-1 should be granted for a well to be drilled in the center of the NEĽNEĽ of Section 12, Township 2 North, Range 93 West, 6th P.M., Rio Blanco County, Colorado, with an allowed tolerance of 200 feet in any direction to avoid surface hazards and obstructions, and that such well should be the permitted well for the drilling unit on which it is located.

 

5. That no objection to Applicant's request was presented.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that an exception to Order No. 201-1 shall be granted for a well to be drilled in the center of the NEĽNEĽ of Section 12, Township 2 North, Range 93 West, 6th P.M., Rio Blanco County, Colorado, with an allowed tolerance of 200 feet in any direction to avoid surface hazards and obstructions, and that such well shall be the permitted well for the drilling unit on which it is located.

 

IT IS FURTHER ORDERED, that the provisions contained herein shall become effective forthwith.
