ADMINISTRATIVE ORDER BY CONSENT

 (Pursuant to Rule 522.e.(1) of the Rules and Regulations of the

Colorado Oil and Gas Conservation Commission, 2 CCR 404-1)

 

FINDINGS

 

1.            Jackie Bruce (Operator No. 11065) is the operator of the Brown-Monfort 1 Well (API No. 05-123-10078) (“Well”) in Weld County, Colorado.

2.            The Well was completed on February 19, 1981 (Doc. No. 123072).

3.            On January 1, 1999, Jackie Bruce became the domestic operator of the Well (Doc. Nos. 1229458 & 2105594).

4.            The Well has had no known commercial production and has only produced gas for domestic purposes.

5.            The Well is no longer capable of production and has been for an undetermined number of years.

6.            Financial assurance in the amount of $1,000 is posted for the plugging and reclamation of the Well (Surety ID 1989-0008 (Inst. No. 3442002497).

7.            During inspections on July 28, 2016 and January 12, 2017, COGCC Staff required the performance of corrective actions at the Well (Doc. Nos. 674602717 and 674603094).

8.            Jackie Bruce is incapable of fulfilling the statutory duties imposed by the Oil & Gas Conservation Act.

AGREEMENT

 

NOW, THEREFORE, based on the Findings, the Director and Jackie Bruce agree to request that the Commission enter the Order set forth below.

ORDER

 

HAVING CONSIDERED the Findings and the Agreement between the Director and Jackie Bruce, the COMMISSION ORDERS:

 

1.            The Well is declared an “Orphaned Well”, as defined in the 100-Series Rules.

2.            The Commission terminates Jackie Bruce’s operator number (Operator No.11065), revokes Jackie Bruce’s Form 1, Registration for Oil & Gas Operations (Doc. No. 1229458) and authorization to conduct oil and gas operations, and suspends Jackie Bruce’s Form 10, Certificate of Clearance (Doc. No. 2105594).

3.            The Commission actions in Paragraph 2 will remain in full force and effect until Jackie Bruce pays any plugging and abandonment costs not covered by the financial assurance, and demonstrates at a Commission hearing that the operator’s oil and gas operations will not threaten to or actually cause significant adverse impacts to public welfare or the environment.

4.            The Director is authorized to foreclose Jackie Bruce’s existing financial assurance (Surety ID 1989-0008 (Inst. No. 3442002497) and claim both the principal and any accrued, but undisbursed, interest that may exist to plug and abandon the Well.

5.            The Director is authorized to apply any salvage value of the Well’s appurtenances to cost of plugging and abandoning the Well at the Director’s discretion.

6.            Jackie Bruce will provide access and cooperate with the Commission for purposes of allowing the Commission or its contractors to properly plug and abandon the Well.

7.            In the event the Director determines, in the Director’s discretion and consistent with the Director’s independent determination of operational priorities, that there is a need to expend funds from the Commission’s Emergency Response appropriation (Long Bill), which is funded by the Oil and Gas Conservation and Environmental Response Fund, to remediate conditions that threaten to cause, or that actually cause, significant environmental impacts at the Well, the Director will confer with the Commission regarding the expenditure of Emergency Response appropriation funds at the earliest practical opportunity.

8.            This Order is effective as of the date it is mailed by the Commission.  It constitutes final agency action for purposes of judicial review.

9.            The Commission expressly reserves its right after notice and hearing, to alter, amend, or repeal any and/or all of the above orders.
