REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on July 17, 1995 at 8:30 a.m., in Suite 801, The Chancery Building, 1120 Lincoln Street, Denver, Colorado, after giving Notice of Hearing as required by law, on why Alex Beltramo, Jr. was not in violation of Rule No. 304 of the Rules and Regulations of the Oil and Gas Conservation Commission, and why it should not invoke the provisions of §34-60-121 C.R.S., as amended, providing for penalties for violations of the Rules and Regulations of the Commission.
FINDINGS
The Commission finds as follows:
1. Alex Beltramo, Jr. is an interested party in the subject matter of the above‑referenced hearing.
2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
4. On April 28, 1994, Commission staff sent a written request to Mr. Alex Beltramo, Jr. requiring submittal of a statewide plugging bond for fourteen (14) wells located in the Florence/Ca_on City Field. Numerous attempts were made from the aforementioned date through January 24, 1995 to have Mr. Beltramo provide a plugging bond. On January 24, 1995, a Notice of Alleged Violation (NOAV) was issued to Mr. Beltramo. On February 23, 1995, Mr. Beltramo contacted staff and requested an extension of the abatement deadline stating the bonding company needed more time to prepare the bonding documents. On March 15, 1995, Mr. Beltramo called staff to say he would supply a Certificate of Deposit (CD) as a bond instead of an insurance bond. On March 24, 1995, staff received a facsimile copy of the CD from Fremont Bank. On April 5, 1995, the bank informed staff that the original CD was in the possession of Mr. Beltramo. Mr. Beltramo assured staff that his attorney would send the original CD. On May 8, 1995, Alex Beltramo submitted the required CD, and on May 12, 1995, staff proposed a recommended fine against Mr. Beltramo for the below-listed wells:

5. At the time of hearing, staff requested that the Commission direct Mr. Beltramo to provide survey plats of all well locations, provide a tour to staff engineers identifying the locations of all Beltramo wells and any other information available on the wells, including technical data and logs.
6. The Commission should find Alex Beltramo, Jr. in violation of Rule No. 304 of the Rules and Regulations of the Oil and Gas Conservation Commission and a fine of one thousand dollars ($1,000) should be imposed.
O R D E R
NOW, THEREFORE, IT IS ORDERED, that Alex Beltramo, Jr. is in violation of Rule No. 304 of the Rules and Regulations of the Oil and Gas Conservation Commission and a fine of one thousand dollars ($1,000) shall be imposed.
IT IS FURTHER ORDERED, that Mr. Beltramo shall provide survey plats of all well locations, provide a tour to staff engineers identifying the locations of all Beltramo wells and any other information available on the wells, including technical data and logs.
IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
