FINDINGS

1.            Kerr-McGee Oil & Gas Onshore LP (“Kerr-McGee”) (Operator No. 47120) is the operator of record of the following locations in Weld County, Colorado (“Subject Locations”):

2.            Rule 603.h. (Statewide Floodplain Requirements) applies to all oil and gas operations within a Floodplain, as defined by the COGCC 100-Series Rules. Pursuant to COGCC Rule 603.h., effective June 1, 2015 for new and April 1, 2016 for existing equipment, operators are required to anchor tanks and separation equipment to the ground with anchors engineered to support the equipment and resist flotation, collapse, lateral movement, or subsidence. Effective June 1, 2015 for new and April 1, 2016 for existing containment berms, operators are required to construct containment berms around all tanks with steel rings or another engineered technology that provides equivalent protection from floodwaters and debris.

Donald Norgren UT D True 1 (“Norgren Location”)

3.            The Norgren Location is located within a Floodplain.

4.            On January 19, 2017, COGCC Staff inspected the Norgren Location and observed an unanchored heated separator, an unanchored crude oil tank, and an earthen containment berm around tanks without steel rings or another acceptable engineered technology. (Action Required Field Inspection Report No. 674004768) This Inspection required Kerr-McGee to complete all corrective actions necessary to comply with Rule 603.h. no later than February 20, 2017

5.            Kerr-McGee anchored the separator on February 15, 2017, anchored crude oil tanks on February 22, 2017, and installed a steel containment berm on February 24, 2017.

Helen Marie Purse B1 (“Purse Location”)

6.            The Purse location is within a Floodplain.

7.            On January 20, 2017, COGCC Staff inspected the Purse Location and observed an unanchored crude oil tank and earthen containment berms around tanks without steel rings or another acceptable engineered technology. (Action Required Field Inspection Report No. 674004796) This Inspection required Kerr-McGee to complete all corrective actions necessary to comply with Rule 603.h. no later than February 20, 2017.

8.            Kerr-McGee anchored the crude oil tanks on February 16, 2017, and installed a steel containment berm on February 24, 2017.

Mathisen James H "B" 2 (“Mathisen Location”)

9.            The Mathisen Location is within a Floodplain.

10.         On December 21, 2016, COGCC Staff inspected the Mathisen Location and observed an unanchored heated separator. (Action Required Field Inspection No. 684902800) This Inspection required Kerr-McGee to complete all corrective actions necessary to comply with Rule 603.h. no later than January 23, 2017.

11.         Kerr-McGee anchored the heated separator on January 25, 2017.

12.         Kerr-McGee staff maintained verbal communication with COGCC Inspection staff while the corrective action work was being carried out at the Subject Locations. During this time, Kerr-McGee staff apprised the COGCC Inspection staff that corrective action work was underway at the locations but that the work would not be fully completed by the corrective action deadlines. COGCC Inspection staff instructed Kerr-McGee staff to file the Field Inspection Report Resolution (“FIRR”) forms (Doc. Nos. 401215330, 401215343, and 401172608) documenting that corrective action work was complete or underway with the understanding that work would be fully completed within a few days.

Other Floodplain Locations

13.         Between December 2016 and April 2017, COGCC inspected other facilities operated by Kerr-McGee located within Floodplains at which COGCC Field Inspectors identified potential violations of COGCC Rule 603.h. Except for the Norgren, Purse, and Mathisen Locations, Kerr-McGee timely completed all Rule 603.h. corrective actions at the other locations at which potential Rule 603.h. violations were identified. (Appendix A)

14.         In March, 2017, Kerr-McGee conducted a comprehensive audit of their locations to review compliance status with Rule 603.h. 

15.         On May 15, 2017, Kerr-McGee submitted a list of facilities identified during the audit and were potentially in violation of COGCC Rule 603.h. As a result of the audit and other initiatives, Kerr-McGee plans to properly anchor and install berms at certain facilities (Appendix B), perform permanent battery removal at certain facilities (Appendix C), and plug and abandon certain wells (Appendix D).

Rule 603.h. Violations

16.         On July 21, 2017, Commission Staff issued the following Notices of Alleged Violation (“NOAVs”) to Kerr-McGee citing violations of COGCC Rules of Practice and Procedure, 2 CCR 404-1 (“Rule” or “Rules”) Rule 603.h.: NOAV No. 401348910 for the Norgren Location; NOAV No. 401348980 for the Purse Location; and NOAV No. 401348983 for the Mathisen Location.

17.         Following factual investigation and legal review of the violations alleged in the NOAV, Hearing Staff now asserts Kerr-McGee has committed the following violations:

18.         Pursuant to Rule 523 and the Commission’s Enforcement and Penalty Policy, Hearings Staff calculated a penalty of $158,250 for this violation. The penalty calculation is based on the following:

 

a.    Application of the Duration Matrix from the COGCC Enforcement Guidance and Penalty Policy January 2015 (corrected 4/8/2015);

b.    Calculated days of violation limited by one-year statute of limitations (§ 34-60-115, C.R.S.) and starting one year prior to the service of the Notices of Alleged Violation, on July 24, 2017;

c.    Violations are deemed to have stopped when all Corrective Actions necessary to comply with Rule 603.h. were completed at the Subject Locations;

d.    Class 2 violation, Minor impact;

e.    Daily base penalty of $2,500;

f.     No aggravating or mitigating factors; and

g.    No pattern of violation, gross negligence, or knowing and willful misconduct.

Compliance Agreement

19.         In addition to Rule 603.h., Kerr-McGee has 70 wells that require, or will require, action by Kerr-McGee to comply with Rule 326 (Mechanical Integrity Testing) (Appendix E). Kerr-McGee will be removing surface equipment at a number of facilities located in Floodplains ahead of the final plugging of the individual wells that produce to those facilities. As a result, there will be a number of wells  subject to the requirements set forth in Rule 319.b (Temporary Abandonment) (Appendix D).

20.         Kerr-McGee and Commission Staff desire to enter into an agreement to resolve the violations at the Subject Locations and comprehensively address Kerr-McGee’s statewide compliance with Rules 603.h., 319.b and 326 by establishing a compliance agreement in this Order that, if fully implemented, will bring Kerr-McGee into full compliance with Rules 603.h., 319.b and 326 at all Kerr-McGee wells.

 

 

AGREEMENT

 

NOW, THEREFORE, based on the Findings and pursuant to Rule 522.e.(1) and the Commission’s Enforcement and Penalty Policy, the Director and Kerr-McGee request that the Commission approve the Order set forth below.

ORDER

 

HAVING CONSIDERED the Agreement between the Director and Kerr-McGee to resolve the NOAV, the COMMISSION ORDERS:

 

1.            Kerr-McGee is found in violation of three counts of Rule 603.h.

2.            Kerr-McGee is assessed a penalty of $158,250 and will pay the full amount within 30 days after this approved AOC is mailed by the Commission.

3.            Compliance Agreement

Kerr-McGee will complete the following Corrective Actions:

a.    No later than December 31, 2017, Kerr-McGee will bring all locations in Appendix B into compliance with Rule 603.h. by anchoring all separators and tanks and installing compliant berms. Alternatively, and in Kerr-McGee’s sole discretion, Kerr-McGee may permanently remove all surface equipment from facilities in Appendix B no later than December 31, 2017 pursuant to Paragraph 3.b. below, and plug and abandon all associated wells no later than March 31, 2018, pursuant to Paragraph 3.c., below. 

b.    No later than December 31, 2017, Kerr-McGee will bring all facilities in Appendix C into compliance with Rule 603.h. by permanently removing all surface equipment from the facilities;

c.    No later than March 31, 2018, or two months after COGCC Staff approve the Form 6, whichever is later, Kerr-McGee will plug and abandon all wells listed in Appendix D to fully comply with Rules 319.b., 326, and 603.h;

                                          i.    In Kerr-McGee’s sole discretion, Kerr-McGee may add wells associated with facilities listed in Appendices B and C to Appendix D for plugging and abandonment.

d.    For all wells associated with the facilities listed in Appendix C and wells listed in Appendix D, Kerr-McGee will submit a Form 5A (Completed Interval Report) reporting the temporary abandonment of these wells within 60 days after surface equipment is removed; and

e.    No later than March 31, 2018, Kerr-McGee will bring all wells in Appendix E into compliance with Rules 319.b. and 326 by either performing a successful mechanical integrity test (“MIT”) or plugging and abandoning the wells.

                                          i.    Kerr-McGee shall retain discretion to shift compliance tasks for wells in Appendix E from plugging and abandonment to MIT based on continuing well evaluation and field assessment so long as all wells in Appendix E are compliant with Rules 319.b. and 326 no later than March 31, 2018.

                                        ii.    COGCC staff will consider wells for which Kerr-McGee has completed a valid MIT and submitted a Form 21 before March 31, 2018 in the good faith belief that the MIT demonstrates mechanical integrity pursuant to Rule 326 to be in compliance with the requirements of this Order. 

4.            Tolling Period

With respect to any alleged, existing, or potential claims related to violations by Kerr-McGee of COGCC Rules 319.b., 326.b., 326.c., or 603.h. at those facilities listed in Appendices A-E, the Parties agree that the statute of limitations provided in the Colorado Oil and Gas Conservation Act, §34-60-115, C.R.S., is tolled beginning on July 26, 2017 and ending when the earliest of the following occurs: (a) Kerr-McGee timely completes all Corrective Actions set forth in Paragraph 3 of this Order; (b) Kerr-McGee fails to complete any of the Corrective Actions by the deadlines set forth in Paragraph 3 of this Order; (c) the Commission vacates this Order; or (d) with respect to any alleged, existing, or potential claims against Kerr-McGee for flood-related environmental damages associated with any of the Locations in Appendices A-E, the COGCC may unilaterally terminate this agreement for those specific locations and issue NOAVs for violations of Rule 603.h., and any other applicable Rules for those specific locations. Upon the occurrence of any of these events, the Tolling Period will be terminated immediately upon delivery of electronic notification from the Director of the COGCC to Kerr-McGee and without further action of the Commission.

a.    For facilities listed in Appendix B to this Agreement, the Commission will not issue any NOAVs for alleged violations of Rule 603.h., until the earliest of either December 31, 2017 or the date on which this Tolling Period otherwise terminates as described above.

b.    For facilities listed in Appendix C, the Commission will not issue any NOAVs for violations of Rule 603.h., until the earliest of either December 31, 2017 or the date on which this Tolling Period otherwise terminates as described above;

c.     For wells listed in Appendix D, the Commission will not issue any NOAVs for alleged violations of Rules 319.b., 326.b., or 326.c. until the earliest of either March 31, 2018 or the date on which this Tolling Period otherwise terminates as described above.

d.    For the wells listed in Appendix E, the Commission will not issue any NOAVs for alleged violations of Rules 319.b., 326.b., or 326.c. until the earliest of either March 31, 2018 or the date on which this Tolling Period otherwise terminates as described above.

5.            Failure to pay the penalty or perform any corrective action by the above deadlines is an independent violation that may be subject to additional penalties.

6.            This Order is effective as of the date it is mailed by the Commission. It constitutes final agency action for purposes of judicial review.

7.            The Commission expressly reserves its right after notice and hearing, to alter, amend, or repeal any and/or all of the above orders.
