THIS MATTER CAME on to be heard the 17th day of September 1990, upon the joint motion for and consent to the entry of an order by the Director of the Colorado Oil and Gas Conservation Commission and the Benson Mineral Group, by and through their counsel.

THE COMMISSION FINDS that:

1. The Commission has full and complete jurisdiction over the subject matter of this action and the parties hereto.

2. Service was made upon all interested parties hereto.

3. The Benson Mineral Group admits to violating the Commission's rule against overproduction. Specifically the violations are as follows:

Two violations of Commission Order No. 451-12 in operating the Croissant 12-16 during June of 1989.

Thirteen violations of Commission Order No. 451-14 in operating the Croissant 12-16 during August of 1989.

Five violations of Commission Order No. 451-14 in operating the Croissant 12-16 during September of 1989.

One violation of Commission order No. 451-15 in operating the Croissant 12-16 during October of 1989.

Eight violations of Commission order No. 451-15 in operating the Croissant 12-16 during November of 1989.

Six violations of Commission Order No. 451-15 in operating the Croissant 12-16 during December of 1989.

4. The parties hereto have agreed and consented to the entry of this Order.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that:

A. The Benson Mineral Group shall pay Three Thousand Five Hundred Dollars ($3,500) to the Colorado Oil and Gas Conservation Commission, within seven days of the entry of this Order, as a civil penalty, pursuant to S 34-60-121f CoReSo 1984 . for said past violations.

B. Payment of the civil penalty is complete and final settlement of the above captioned matter.
