REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on March 17, 1986 at 9:00 a.m., in Room 110 State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the alleged violation by Dennis J. Weber of Rule Nos, 324 (a) and 325 of the Rules and Regulations of the Oil and Gas Conservation Commission.

FINDINGS

The Commission finds as follows:

1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law,

2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. On January 29, 1986, water alleged to be produced from oil and gas field operations was observed to have been dumped onto the ground behind a residence located in the SEE/4 Section 26, Township 18 South, Range 44 West, 6th P.M., Kiowa County, Colorado.

4. Although included in the Notice of Hearing, the Commission determined that Weber's Water Service should not be considered a party in this matter,

5. Evidence presented at the hearing was insufficient to indicate that the water observed being dumped was oil field waste, therefore there was no violation of Rule Nos. 342 (a) and 325.

O R D E R

NOW, THEREFORE, IT IS ORDERED, that no violation of Rule Nos. 324 (a) and 325 occurred and the allegations against Dennis J. Weber are hereby dismissed.
