REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on February 21, 1986 at 9:00 a.m., in Room 110 State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion concerning the violation by Tom Fenno of Rule Nos, 316, 324 and 325 of the Rules and Regulations of the Commission.

FINDINGS

The Commission finds as follows:

1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. On December 4, 1985, Dr. Lawrence Johnson of the Larimer County Health Department advised the Commission that members of his staff observed dumping of water produced with oil and gas at a location 3 miles north and 2 miles east of the Clarks Lake Field which is located in Sections 15 and 22, Township 9 North, Range 68 West, 6th P.M. The truck, License LU-2509, has been identified as belonging to Tom Fenno of Platteville, Colorado. This is in violation of the Rules and Regulations of the Commission.

4. The violation was acknowledged by Mr. Fenno and the cooperation by Mr. Fenno in resolving this matter was noted. However, since a violation did occur, a penalty should be assessed.

O R D E R

NOW, THEREFORE IT IS ORDERED, that Tom Fenno, in accordance with 34-60-121, is hereby assessed a fine of Two Hundred Fifty Dollars ($250.00), which is to be remitted to the Oil and Gas Conservation Commission within 30-days upon receipt of this order.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
