REPORT OF THE COMMISSION

This cause came on for bearing before the Commission on February 12, 1988 at 9:00 a.m., in Room 110, State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing, as required by law on the Commission's own motion, concerning the violation of Rule 325 of the Rules and Regulations by Mustang Well Services, Inc.

FINDINGS

1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. Mustang Well Services, Inc. dumped several loads of drilling fluids along the side of Road FF in Washington County, Colorado. This is in violation of Rule 325 of the Rules and Regulations of the Commission.

4. Mustang Well Services, Inc., by its corporate officers, at the time of hearing, acknowledged its failure to properly dispose of drilling fluids, and the Commission determined a violation of the Rules and Regulations did occur and a penalty of Five hundred dollars ($500.00) should be assessed and Mustang Well Services, Inc. should clean up and restore said dumping areas to the satisfaction of the appropriate Washington County road authorities when weath er permits.

5. Based on the testimony presented and knowledge of the liquids involved, the materials dumped are not considered to be hazardous materials.

O R D E R

NOW, THEREFORE IT IS ORDERED, that Mustang Well Services, Inc., in accordance with 34-60-121, C.R.S., as amended, is hereby assessed a fine of Five hundred dollars ($500.00) which is to be remitted to the Oil and Gas Conservation Commission, State of Colorado within thirty (30) days upon receipt of this order.
