REPORT OF THE COMMISSION

TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:

This cause came on for hearing before the Commission on November 16, 1987 at 9:00 a.m., in Room 110 State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion concerning the violation of Rule 316 of the Rules and Regulations of the Commission by J. J. Water Services.

FINDINGS

The Commission finds as follows:

l. Due to notice of the time, place and purpose of the hearing has been given in all aspects as required by law.

2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. On July 17, 1987 and September 30, 1987 the Commission requested from J. J. Water Services transporter reports as required by Rule 316. No response to these requests were received and J. J. Water Services was therefore alleged to have violated the Rule 316 of the Rules and Regulations of the Commission.

4. The required reports were submitted on November 6, 1987, however J. J. Water Services failed to appear before the Commission as requested at its hearing on November 16, 1987.

5. The Commission determined that a violation of Rule 316 did occur and a penalty of Two Hundred Fifty Dollars ($250.00) should be assessed and in addition a reprimand of J. J. Water Services for failure to appear.

O R D E R

NOW, THEREFORE, IT IS ORDERED, that J. J. Water Services, in accordance with 34-60-121 C.R.S., as amended, is hereby assessed a fine of Two Hundred Fifty Dollars ($250.00) , which is to be remitted to the Oil and Gas Conservation Commission, State of Colorado within thirty (30) days upon receipt of this order.

IT IS FURTHER ORDERED that J. J. Water Services is hereby reprimanded for failure to appear at the Commission hearing on November 16, 1987.
