REPORT OF THE COMMISSION
TO ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:
This cause came on for hearing before the Commission on March 16, 1987 at 9:00 a.m. in Room 110, State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing, as required by law, on the Commission's own motion ordering Illinois Basin Exploration, Inc. to appear and show cause why the Commission should not invoke the provisions of 34-60-121 C.R.S. providing for penalties for violation of the Rules and Regulations for fai lure to file security in accordance with Rule 304 for several wells in Adams and Weld Counties, Colorado.
FINDINGS
The Commission finds as follows:
1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. Statements made by Harold Murbarger, President of Illinois Basin Exploration Inc., at the time of hearing, indicate that attempts to obtain a bond to cover the wells purchased from Oiltech, Inc., the previous operator have met with failure.
3. An offer to purchase the wells from Illinois Basin has been made; however, additional time is needed to finalize this offer.
4. The blanket bond of Oiltech, Inc. is still in effect.
5. Additional time of forty-five (45) days from the date of hearing should be given to Illinois Basin Exploration, Inc. in order to finalize the matter; however the Commission should take further action if the matter is not resolved at the end of said time period.
O R D E R
NOW THEREFORE, IT IS ORDERED that Illinois Basin Exploration Inc. shall be given forty-five (45) days from the date of hearing in which to obtain security to cover the twenty-seven (27) wells (see attached Exibit. A) in accordance with Rule 304 of the Rules and Regulations of the Commission or transfer the wells to a properly bonded party.
IT IS THEREFORE ORDERED, that should the matter not be resolved at the end of the forty-five day period, the Commission shall take such further action as it deems appropriate.
