Pursuant to a hearing before the Oil and Gas Conservation Commission on February 15, 2000, at the Holiday Inn, Trinidad, 3125 Toupal Drive, Trinidad, Colorado, the Oil and Gas Conservation Commission promulgated amendments to its Rules and Regulations to repeal and re-enact Rule 305.c.(6) as shown below.
305.c. Notice requirements. As to notices to be given pursuant to Rule 305., included with each such notice shall be the following:
(6) A copy of the Commission’s informational brochure for surface owners, containing the rules pertaining to notice of oil and gas operations and opportunities for consultation thereon, as well as the rules of procedure for filing complaints and making applications for hearing. The brochure shall provide contact information for the Commission’s main office, field offices and website, and shall describe the services and information available to the public, including access to a listing of local governmental designees. The brochure shall contain a prominent disclaimer advising surface owners to obtain legal advice as may be appropriate to their particular circumstances.
Attached, as Exhibit A, is a statement giving the basis and purpose of the revisions and such statements are incorporated herein by reference.

STATEMENT OF BASIS AND PURPOSE
§34-60-106.(14), C.R.S., as amended, gives the commission authority to provide a means for giving reasonable advance notice of the commencement of oil and gas operations to the appropriate local government and surface owners whose lands will be affected thereby.
Amend Rule 305.b.(6) to require oil and gas operators to provide surface owners with the COGCC brochure, entitled “Oil and Gas Well Notification, Consultation and Reclamation Rules Information for Oil and Gas Operators, Surface Owners and Surface Tenants.
