REPORT OF THE COMMISSION

TO ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:

Pursuant to a hearing before the Oil and Gas Conservation Commission of the State of Colorado (“Commission”) on November 16-17, 2015, in the Governor’s Square 14 Room at the Sheraton Denver Downtown Hotel, 1150 Court Place, Denver, Colorado, and continuing on December 7, 2015, and January 25, 2016, in UCD’s School of Public Affair's Terrace Room on the 2nd floor of 1380 Lawrence St., Denver, Colorado, the Commission promulgated amendments to its Rules of Practice and Procedure, 2 CCR 404-1 (“Rules”), as described in Appendix A.  Also attached and incorporated into this Order is the Statement of Basis and Purpose in Appendix B.   

This “Governor’s Task Force Rulemaking” was in response to two recommendations unanimously adopted by the Governor’s Oil and Gas Task Force on February 24, 2015. The Commission conducted this rulemaking pursuant to Sections 34-60-105, 106(1)(b), 106(2)(c), 106(2)(d), 106(11)(a)(II), C.R.S. The Commission adopted a new definition in the 100-Series Rules and new Rules 302.c., 305A, and 604.c.(4), as well as amended Rules 303.b.(3)K, 303.c., 305.a.(1), 305.d., 306.d.(1), and 604.b.(1) (collectively, the “Task Force Rules”).  

Following adoption by the Commission, these proposed new and amended rules will become effective twenty days after publication by the Secretary of State pursuant to §24-4-103(5), C.R.S. All provisions of these rules will be applied prospectively to any Application for Oil and Gas Location Assessment, Form 2A, for a Large UMA Facility submitted after the effective date. For Form 2A applications submitted but not approved prior to the effective date, pre-application notices and consultations otherwise required by Rule 305A will be waived, but applicable best management practices and mitigation measures pursuant to Rule 604.c.(4) will be required.
