REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on June 14, 1966, at 10 A.M., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Davis Drlg., Inc. for an order establishing 640-acre drilling and spacing units for the production of gas from the Topeka Limestone Structure underlying certain lands in Townships 30 and 31 South, Range 44 West, and Townships 30 and 31 South, Range 45 West, 6th P.M., Baca County, Colorado.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That evidence presented at the hearing indicates that the Topeka Limestone Structure constitutes a common source of supply of gas underlying the following described lands in Baca County, Colorado, to-wit:

4. That in order to prevent waste of gas, as defined by law; to protect the correlative rights of all parties concerned; to prevent the drilling of unnecessary wells; and to insure proper and efficient development and promote conservation of the gas resources of the State, an order should be made establishing drilling units of the size and shape of the sections described in Finding 3 herein; that said drilling units should consist of complete governmental-surveyed [sic] sections; and that the permitted gas well for such drilling unit should be located within a radius of 1200 feet of the center of any such drilling unit.
5. That all available geological and engineering data concerning said Topeka Limestone formation indicate that one well will adequately and efficiently drain an area equal to that contained in the sections as set forth in Finding 3 herein. 6. That all wells drilled and on record in the office of the Oil and Gas Conservation Commission should be permitted as exceptions for the drilling units on which they are located, where re-entry is requested and no well has been completed as a producible gas well on the same drilling unit.
ORDER
NOW, THEREFORE, IT IS ORDERED that the following rules and regulations shall apply to wells heretofore and hereafter drilled and completed or recompleted in the Topeka Limestone formation of the Vilas Field, as defined herein, in addition to other applicable rules, regulations and orders of the Commission heretofore adopted and not in conflict herewith:
Rule 1. Drilling units corresponding to the sections as set forth below shall be, and the same are hereby established for the production of gas and associated hydrocarbons from the Topeka Limestone formation, common source of supply underlying the following described lands in Baca County, Colorado, to-wit:

and such area shall henceforth be known as the Vilas Field.
Rule 2. Said drilling units shall consist of complete governmental-surveyed sections, as described in Rule 1 hereof; and the permitted gas well for each drilling unit shall be located within a radius of 1200 feet of the center of any such drilling unit.
IT IS FURTHER ORDERED, that all wells drilled and on record in the office of the Oil and Gas Conservation Commission shall be permitted as exceptions for the drilling units on which they are located, where re-entry is requested and no well has been completed as a producible gas well on the same drilling unit.
IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of #197-1 any well or wells in the Topeka Limestone formation, as defined herein, for the purpose of producing gas or associated hydrocarbons therefrom, at a location other than authorized by this order, is hereby prohibited.
